Implementasi Peraturan Presiden Republik Indonesia No. 16 Tahun 2018 Tentang Pengadaan Barang Dan Jasa Pemerintah (Studi Pada Unit Pelaksana Teknis Jalan Dan Jembatan Kotanopan Dinas Bina Marga Dan Bina Konstruksi Provinsi Sumatera Utara)

Abstract

Implementasi kebijakan dalam Pepres belum sepenuhnya dapat diterapkan. Hal ini terlihat dari beberapa penyelesaian proyek yang tidak disertai dengan pemeriksaan hasil pekerjaan secara menyeluruh yang berakibat pada diterimanya hasil pekerjaan yang kurang sesuai dengan kontrak. Rumusan masalah penelitian ini adalah bagaimana implementasi dan faktor kendalanya dalam implementasi Peraturan Presiden Republik Indonesia No. 16 Tahun 2018 Tentang Pengadaan Barang dan Jasa Pemerintah pada Unit Pelaksana Teknis Jalan dan Jembatan Kotanopan Dinas Bina Marga dan Bina Konstruksi Provinsi Sumatera Utara. Penelitian yang digunakan adalah metode deskriptif, dan teknik analisis data menggunakan deskriptif kualitatif. Hasil penelitian bahwa Unit Pelaksana Teknis Jalan dan Jembatan Kotanopan Dinas Bina Marga dan Bina Konstruksi Provinsi Sumatera Utara belum dapat mengimplementasikan Perpres No. 16 tahun 2018 dengan baik, dimana jalan dan jembatan masih kurang memenuhi kebutuhan masyarakat serta kualitasnya juga masih sering menyimpang dari spesifikasi kontrak. Faktor kendala dalam implementasi PBJ yaitu adanya oknum yang berupaya memperoleh keuntungan pribadi dari pelaksanaan proyek jalan dan jembatan, penyediaan anggaran oleh pemerintah sering terlambat sehingga menyebabkan pelaksanaan proyek tersendat, sering kesulitan mengidentifikasi kebutuhan jalan dan jembatan yang paling mendesak karena lemahnya sistem informasi, serta kurangnya kerjasama dari perusahaan mitra eksternal yang berupaya menutupi kelemahan dalam hasil pengerjaan proyek pada saat serah terima. Direkomendasikan pimpinan perlu menindak tegas oknum yang berupaya memanfaatkan proyek pengadaan barang dan jasa untuk keuntungan pribadinya. Pemerintah sebaiknya berupaya menyediakan anggaran proyek secara tepat waktu, sehingga pelaksanaan proyek dapat berjalan dengan lancar. Sebaiknya instansi memperbaiki sistem informasinya agar semua informasi kebutuhan pengadaan barang dan jasa dapat segera terkumpul dengan cepat. Sebaiknya petugas pemeriksa bersikap tegas untuk tidak menandatangani serah terima barang dan jasa sebelum kekurangan kualitas diperbaiki oleh pemasok mitra eksternal. The implementation of policies in the Presidential Decree has not been fully implemented. This can be seen from several project completions that were not accompanied by a thorough inspection of the work results which resulted in the receipt of work that was not in accordance with the contract. The formulation of the research problem is how to implement it and the constraints in implementing the Presidential Regulation of the Republic of Indonesia No. 16 of 2018 concerning Procurement of Government Goods and Services to the Kotanopan Road and Bridge Technical Implementation Unit of the Highways and Construction Services of North Sumatra Province. The research used is descriptive method, and data analysis techniques use descriptive qualitative. The results of the study showed that the Kotanopan Road and Bridge Technical Implementation Unit of the Highways and Construction Services of North Sumatra Province had not been able to implement Presidential Decree No. 16 of 2018 properly, where roads and bridges still do not meet the needs of the community and their quality also often deviates from contract specifications. Obstacle factors in the implementation of PBJ are the existence of individuals who seek personal benefits from the implementation of road and bridge projects, the provision of budget by the government is often late, causing project implementation to falter, it is often difficult to identify the most urgent road and bridge needs due to weak information systems, and lack of cooperation from an external partner company that seeks to cover up weaknesses in the results of project work at the time of handover. It is recommended that the leadership take firm action against individuals who try to take advantage of goods and services procurement projects for their personal gain. The government should strive to provide project budgets in a timely manner, so that project implementation can run smoothly. Agencies should improve their information systems so that all information needed for the procurement of goods and services can be collected quickly. Inspectors should be firm about not signing the handover of goods and services before quality deficiencies are corrected by external partner suppliers.
