dc.description.abstract | Penelitian ini bertujuan untuk mengetahui bentuk tindak pidana penipuan praktik real money trading pada game online dan penerapan sanksi pidana bagi pelaku penipuan praktik real money trading pada game online. Metodologi penelitian ini adalah penelitian yuridis dengan pendekatan empiris dengan sifat deskriptif. Hasil penelitian ini menunjukkan bahwa bentuk tindak pidana penipuan praktik real money trading pada game online terjadi karena beberapa faktor internal yang terdiri dari akibat publisher game online mengenalkan real money trading, publisher memberikan batasan ijin tertentu dalam melakukannya, dan adanya batasan dalam permainan. Selain itu ada juga faktor eksternal yang terdiri dari karena pemain mendapat keuntungan, mempersingkat waktu untuk mencapai level tertentu, memperkuat karakter pemain, dan memiliki skin karakter menarik yang tidak dimiliki banyak pemain. Penerapan sanksi pidana kasus penipuan dalam praktik real money trading antar pemain game online terjadi karena adanya berita bohong dan menyesatkan yang menyebabkan kerugian terhadap pemain game online selaku konsumen dalam transaksi elektronik menggunakan Pasal 28 Ayat (1) Undang-undang No. 19 tahun 2016 tentang perubahan atas Undang- Undang No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE) beserta sanksinya yang terdapat dalam Pasal 45A Ayat (1) Undang-undang No. 19 tahun 2016 tentang perubahan atas Undang-Undang No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE). Oleh karena itu, jika terjadi penipuan dalam praktik real money trading antar pemain game online, pasal yang dapat diterapkan adalah Pasal 28 Ayat (1) Undang-undang No. 19 tahun 2016 tentang perubahan atas Undang-Undang No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE) jo. Pasal 45A Ayat (1) Undang-undang No. 19 tahun 2016 tentang perubahan atas Undang-Undang No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE) selama unsur-unsurnya terpenuhi. Kata kunci: Penipuan, Real Money Trading, Game Online This study aims to determine the form of criminal acts of fraudulent real money trading practices in online games and the application of criminal sanctions for perpetrators of fraudulent real money trading practices in online games. The research methodology is a juridical research with an empirical approach with a descriptive nature. The results of this study indicate that the criminal act of defrauding the practice of real money trading in online games occurs due to several internal factors consisting of online game publishers introducing real money trading, publishers giving certain permission restrictions in doing so, and there are restrictions in the game. Apart from that, there are also external factors, which consist of players getting an advantage, shortening the time to reach a certain level, strengthening player characters, and having attractive character skins that not many players have. The application of criminal sanctions for fraud cases in the practice of real money trading between online game players occurs because of false and misleading news that causes harm to online game players as consumers in electronic transactions using Article 28 Paragraph (1) of Law No.19 of 2016 concerning amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions (ITE) and the sanctions contained in Article 45A Paragraph (1) of Law no. 19 of 2016 concerning amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions (ITE). Therefore, if fraud occurs in the practice of real money trading between online game players, the article that can be applied is Article 28 Paragraph (1) of Law no. 19 of 2016 concerning amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions (ITE) jo. Article 45A Paragraph (1) Law No. 19 of 2016 concerning amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions (ITE) as long as the elements are met. | en_US |
