dc.description.abstractTulisan ini bertujuan untuk mengetahui jenis per,janjian jual beli tanah yang dapat me imbulkan konflik, untuk mengetahui tindakan penanganan perdanjian _Jal beli tan ah yang dapat menimbulkan konflik, untuk mengetahui bagaimana moti asi dan tindakan PPAT/Notaris dalam menangani perjanjian jual bcJi tanah •ang dapat menimulkan konflik. Metode yang digunakan dalam penulisan skripsi adalah metode deskriptif, maksudnya menggambarkan atau menelaah permasalahan hokum terhadap f'lerjan"ian peralihan hak atas tanah yang dapat menimbulkan konflik, library resear h, maksudnya adalah penelitian yang dipusatkan kepada studi kepustakaan untuk mcndapatkan data yang relcvan dengan pcnyusunan skripsi ini, yaitu melalui buku-buku, majalah-majalah, tulisan dan: karangan ilmiah, di samping itu dipergunakan penelitian lapangan terhadap perjanjian jual beli yang dapat menimbulkan konflik, dan berlangsung ditengah-tengah masyarakat. Perbuatan hokum mengenai perjanjian jual beli tanah tidak tertutup kemungkinan transaksi yang dilakukan para pihaj yang mengandung pen11asalahan-pcrmasalahan yang tidak sekedar formal-yuridis, tetapi juga non yuridis Pcr.ianjian jual beli yang dapat mcnimbulkan konflik ini antara lain discbabkan karcna, syarat-syamt tcrtulis tidak tcrpcnuhi ~ antara lain : scrtifilrnt aak atas tanah yang menjadi objek perjanjian scdang dalam keadaan agunan ha'nk, sertifik,at hak atas tanah masih tcrdaftar atas nama orang Jain dan pembeli hclum cukup umur, jual beli tanah sawah yang terdaftar dalam scrtifikat masih atas nanrn orang tuanya, sedang pembeli bertempat tinggal di luar dacrah. Syarat-syarat tid al: tertnlis tidak terpenuhi antara lain : Jual beli tanah yang scdang dijaclikan jaminan , kredit di l}ank discrtai pernyat~an pemberi utang bersedia 1ncnyerahirnn sis ~ harga tanah, jual bcli surat tanah discrtai surat pembcri pcrnyataan rncmbcd hal\ pertama kepada pcnjual untuk membcli kcmbali. Jual bcli tanah ~ cba :~ai kompensasi utang pe11jua} kepada pembelJ. Menghadapi perjanjian yang dapat menimbulkan konflik dalam arti tidak tcrpenubi syarat-syarat formal ( tertulis ), ticlak tersedia syarat,-syarat materiHl ( tidak tertuli~ ), dap tidak berhaknya para pihak mclakukan perjanjian. PPAT/Notaris dapat melakukan bentuk..:bentuk tindakan sepcrti ~ sy?.rat-syarat formai suatu akta dijadikan sebagai syar-at mutlak untuk dipcnuhi para pihak sebelum_ al~ta jqal beli tanab dibuat. Motivasi dan tindakan PPAT/Notaris dalam menangani perjanjian peralihan bak atas tanah yang dapat menimbulkan konflik, diJasarkan atas : pertimbangan sukses, perthnhangan nilai, peJiimbangan pengalaman cfan pertimbangan kesempatan langka. Sebaiknya sebelum memutuskan tindakan, PPAT/Notaris harus mampu _menganalisis situasi dan konflik, mengakomodasikan kepentingan hukum dan kepentingan sosial dalam pembuatan akta PPAT/Notaris. This paper aims to determine the types of land sale and purchase agreements can cause conflict, to know the action of handling the agreement _Jal buy land that can lead to conflict, to know how motivation and actions of the PPAT/Notary in handling land purchase agreements that can give rise to conflict. The method used in writing thesis is descriptive method, means to describe or examine legal issues against f'lerjan"ian transfer of land rights that can lead to conflict, library research h, meaning that research is focused on library research to obtain data relevant to the preparation of this thesis, namely through books, magazines, writings and scientific essays, in addition used field research on sale and purchase agreements that can be cause conflict, and take place in the midst of society. The legal action regarding the land sale and purchase agreement is not covered possible transactions carried out by the pregnant parties issues that are not only formal-juridical, but also non-juridical juridical Sale and purchase agreements that can give rise to this conflict, among others due to the fact that the written requirements were not met, including: valid the son of the land which is the object of the agreement is in a state of collateral ha'nk, certificates for land rights are still registered in the names of Jains and land buyers old enough, the sale and purchase of paddy fields registered in the certificate is still above nanrn his parents, while the buyer lives outside the area. Terms of tid al: the written records are not fulfilled, among others: Sale and purchase of land that is being guaranteed, credit at l}ank is accompanied by a statement from the debtor that they are willing to give up sis ~ price land, sale and purchase of land certificates accompanied by a letter of acknowledgment of the matter first to the seller to buy back. Sale of land bcli ~ cba :~ai compensation for the seller's debt to the buyer. Facing agreements that may lead to conflict in the sense that they do not fulfilled formal (written) requirements, no material requirements available (not deaf ~ ), the parties are not entitled to enter into an agreement. The PPAT/Notary can take forms of action such as sy?rat-requirements The form of a deed is used as an absolute requirement to be fulfilled by the parties before_ al~ta jqal buying land was made. Motivation and actions of the PPAT/Notary in handling the transfer agreement rights over land that can cause conflict, based on: considerations success, value judgment, balancing experience and consideration rare opportunity. Preferably before deciding on action, the PPAT/Notary must be capable _analyze situations and conflicts, accommodate legal interests and social interests in making PPAT/Notary deed.en_US
