Abstract: | Kesimpulan 1. Pada prinsipnya suatu penyitaan itu harus terlebih dahulu ada izin dari Ketua Pengadilan Negeri setempat kecuali dalam hal penyitaan itu dilakukan karena terpaksa atau mendesak, maka setelah itu penyidik harus segera melaporkannya kepada ketua Pengadilan Negeri setempat untuk memperoleh persetujuan atas pelaksanaan penyitaan yang dilakukan. 2. Bahwa angka penyitaan di wilayah hukum Ditserse Poldasu Medan angka penyitaan cukup tinggi clan Ketua Pengadilan Negeri Medan belum pernah menolak memberikan persetujuan atas penyitaan yang sebelumnya telah dilakukan oleh Ditserse Poldasu Medan. 3. Apabila benda yang disita tidak lagi diperlukan kepentingan atau kegunaannya baik pada tingkat penyidikan, penuntutan maupun di peradilan, maka benda sitaan yang dimaksud dikembalikan kepada yang paling berhak kecuali benda tersebut dianggap berbahaya, maka benda yang berbahaya tersebut dimusnahkan negara. 4. Dalam melaksanakan razia, seringkali polisi melakukan penggeleahan badan dan barang, yang mana sekaligus melakukan tindak penyitaan dan penyitaan tersebut sebelumnya tidak mempunyai izin dari Ketua Pengadilan Negeri setempat. Conclusion 1.
