dc.description.abstract | Tanah merupakan asset yang sangat penting bagi kehidupan manusia. Manusia dalam kehidupannya selalu tidak pernah terlepas dari tanah. Fungsi penting dari tanah merupakan salah satu sumber utama bagi keberlangusngan hidup manusia dan penghidupan bangsa dalam mencapai kemakmuran rakyat yang sebesar-besarnya. Permasalahan dalam penelitian ini adalah mengenai persetujuan lisan dalam sahnya jual beli tanah warisan, bagaimana proses sengketa tanah pada Putusan No. 123/Pdt. G/2016/PN. Medan, bagaimana pertimbangan putsan hakim dalam menetapkan sahnya jual beli tanah dalam putusan terkait. Metode yang digunakan dalam penelitian ini adalah penelitian kepustakaan yaitu melakukan penelitian terhadap berbagai sumber bacaan, buku-buku, pendapat para sarjana, peraturan perundang-undangan, dan juga bahan-bahan kuliah. Penelitian lapangan yaitu, dengan melakukan riset kelapangan dalam hal ini penulis langsung melakukan studi pada Pengadilan Negeri Medan dengan mengambil Putusan No. 123/Pdt. G/2016/PN. Medan untuk dianalisis. Dalam penelitian ini didapatkan kesimpulan bahwa jual beli tanah yang dilakukan pada Putusan No. 123/Pdt. G/2016/PN. Medan dengan persetujuan ahli waris secara lisan dari ahli waris yang tidak dapat hadir itu sah menurut hukum. Pertimbangan hakim dalam Putusan No. 123/Pdt. G/2016/PN. Medan dengan menetapkan sahnya jual beli atas tanah, menimbang bahwa karena penggugat rekopensi dapat membuktikan dalilnya dalam gugatan rekopensi maka menjadi tidak relevan lagi mempertimbangkan bukti-bukti lain yang diajukan di persidangan oleh tergugat rekopensi. Maka gugatan penggugat atas objek terpekara ditolak. Land is a very important asset for human life. Humans in life are always inseparable from the soil. The important function of land is one of the main sources for the continuity of human life and the livelihood of the nation in achieving the greatest prosperity of the people. In particular, inheritance land may be owned by several heirs as co-owners of a plot of land. The problem in this research is regarding verbal approval in the legality of buying and selling inherited land, how is the process of land disputes in Decision No. 123/Pdt. G/2016/PN. Medan, what is the consideration of the judge's decision in determining the validity of the sale and purchase of land in the related decision. The method used in this research is library research, namely conducting various reading sources, books, opinions of scholars, laws and regulations, and also lecture materials. Field research, namely, by conducting field research in this case the author directly conducts a study at the Medan District Court by taking Decision No. 123/Pdt. G/2016/PN. Field to be analyzed. In this study, it was concluded that the sale and purchase of land carried out in Decision No. 123/Pdt. G/2016/PN. Medan with the verbal approval of the heirs of the heirs who are unable to attend is legal according to law. Judge's consideration in Decision No. 123/Pdt. G/2016/PN. Medan, by stipulating the validity of the sale and purchase of land, considers that because the plaintiff in the counterclaim can prove his argument in the counterclaim, it is no longer relevant to consider other evidence presented at the defendant's counter-terrorism trial. So the lawsuit on the object of the case is rejected. | en_US |
