Abstract: Kecelakaan lalu lintas, Polri bertanggung jawab untuk menyelesaikan konflik antara pihak yang terlibat secara profesional. Menggunakan metode mediasi pidana yang juga dikenal sebagai mediasi penal untuk mencapai perdamaian. Permasalahan penelitian ini, pengaturan hukum terhadap restorative justice dalam perkara kecelakaan lalu lintas. Kedudukan restorative justice dalam penyelesaian perkara lalu lintas di Polrestabes Medan. Metode penelitian normatif dengan wawancara pada Wakasat Laka Lantas Polrestabes Medan. Penelitian bersifat deskriptif analitis. Penelitian menggunakan data primer dan sekunder. Pengumpulan data dilakukan melalui studi pustaka dan studi lapangan, dianalisis secara kualitatif. Pengaturan hukum terhadap restorative justice dalam perkara kecelakaan lalu lintas diatur dalam Pasal 310 UU No 22 Tahun 2009 tentang Angkuta Jalan. Perpol Nomor 08 Tahun 2021 mengatur tentang Penanganan Tindak Pidana berdasarkan Keadilan Restoratif, yang akan digunakan sebagai acuan dasar penyelesaian perkara dalam proses penyelidikan dan penyidikan tindak pidana, sehingga memberikan kepastian hukum, diatur tentang penghentian penyelidikan dan penhentian penyidikan alasan demi hukum berdasarkan keadilan restoratif. Kedudukan restorative justice dalam penyelesaian perkara lalu lintas di Polrestabes Medan. Polisi berwenang melakukan tindakan apa saja, termasuk penyelesaian perkara pidana di luar pengadilan diatur dalam Pasal 16 ayat (2) jo. Pasal 18 ayat (1) UU No 2 Tahun 2002 bahwa “dalam hal yang sangat perlu dan mendesak. Perpol Number 08 of 2021 regulates the Handling of Crimes based on Restorative Justice, which will be used as a basic reference for settling cases in the process of investigation and investigation of criminal acts, so as to provide legal certainty, regulates the termination of investigations and termination of investigations for legal reasons based on restorative justice.
