Abstract: Pemberian kredit ini bersifat mengikat bagi para pihak, apabila para pihak melakukan wanprestasi, maka perjanjian batal demi hukum. Perjanjian kredit yang merupakan perjanjian konsesuil, antara kedua belah pihak sudah ditetapkan bahwa debitur memiliki kewajiban untuk melakukan pelunasan pinjamannya sesuai dengan ketentuan yang sudah disepakati. Berdasarkan hal tersebut permasalahan dalam penelitian ini yaitu bagaimana aturan hukum mengenai wanprestasi terhadap perjanjian kredit, bagaimana mekanisme permberian kredit dari kreditur kepada debitur, dan bagaimana pertimbangan hakim dalam mengadili perkara pada Putusan Nomor: 290/Pdt.G/2021/PN Mdn. Metode penelitian yang digunakan yaitu yuridis normatif dengan analisis data yang digunakan yaitu deskriptif analisis. Teknik pengumpulan data yang digunakan adalah Metode studi pustaka (library research) dan metode studi lapangan (field research). Hasil penelitian adalah aturan hukum mengenai wanprestasi terhadap perjanjian kredit diatur pada pasal 1238 BW. Mekanisme pemberian kredit dilakukan dengan memperhatikan prinsip 5C dan prinsip 7P.Yang menjadi pertimbangan hakim dalam menjatuh putusan adalah Eksepsi, bukti-bukti surat yang diajukan para pihak, dan Gugatan. Saran yang diberikan adalah aturan mengenai perjanjian pemberian kredit harus diatur didalam aturan khusus, mekanisme pemberian kredit harus diperjelas didalam Undang-Undang Perbankan dan dalam menjatuhkan putusan dalam sengketa perjanjian kredit, Majelis Hakim harus memperhatikan peraturan perundang-undangan yang berlaku, memperhatikan asas keadilan, kepastian hukum dan kemanfaatan. This credit granting is binding for the parties, if the parties default, the agreement is null and void. A credit agreement which is a consecutive agreement, between the two parties it has been determined that the debtor has an obligation to repay the loan in accordance with the agreed terms. Based on this, the problems in this study are how the legal rules regarding defaults on credit agreements, how the mechanism for granting credit from creditors to debtors, and how the judge's consideration in adjudicating the case in Decision Number: 290/Pdt.G/2021/PN Mdn. The research method used is normative juridical with the data analysis used is descriptive analysis. The data collection techniques used are the library research method and the field research method. The result of the research is that the legal rules regarding defaults on credit agreements are regulated in article 1238 BW. The mechanism for granting credit is carried out by paying attention to the 5C principle and the 7P principle. What is considered by the judge in making a decision is the Exception, the letter evidence submitted by the parties, and the Lawsuit. The suggestions given are that the rules regarding credit granting agreements must be regulated in special rules, the mechanism for granting credit must be clarified in the Banking Law and in making decisions in credit agreement disputes, the Panel of Judges must take into account the provisions of the Banking Law.
