dc.description.abstractKebijakan kriminal merupakan strategi rasional masyarakat dalam mengatasi. Kebijakan hukum pidana adalah subbidang ilmu hukum pidana yang fokus pada pencegahan kejahatan. Di Indonesia, pemerintah telah menerbitkan undang-undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik (UU ITE). Untuk mengendalikan penggunaan teknologi informasi dan media sosial guna menjaga keadilan, ketertiban umum, dan kepastian hukum. Pencemaran nama baik merupakan tindakan mencemarkan nama baik merujuk pada Tindakan merugikanreputasi seseorang melalui lisan atau tulisan. Pasal 27 ayat (3) UU ITE mengatur pencemaran nama baik. Permasalahan dalam penelitian ini adalah mengeksplorasi kebijakan penal dan non-penal dalam menangani kejahatan pencemaran nama baik diruang siber. Metode yuridis normatif digunakan untuk menganalisis solusi hukum terhadap permasalahan ini. Data primer, sekunder, dan tersier digabungkan untuk menyelidiki persoalan ini. Pendekatan populasi dan sampel digunakan untuk menjawab pertanyaan penelitian. Penelitian ini menganalisis efetivitas kebijakan kriminal dan non-kriminal dalam menangani pencemaran nama baik di dunia digital, memberikan wawasan penting bagi perbaikan regulasi di masa depan. Criminal policy is society's rational strategy for coping. Criminal law policy is a criminal law subfield that focuses on crime prevention. The government in Indonesia has issued Law Number 19 of 2016 concerning Electronic Information and Transactions (ITE Laws) to control the use of information technology and social media to maintain justice, public order, and legal certainty. Defamation is defiling a good-name act, referring to actions that harm someone's reputation through oral or written means. Article 27, paragraph (3) of the ITE Law regulates defamation. The research problem was to explore penal and non-penal policies in dealing with defamation crimes in cyberspace. Normative juridical methods were used to analyze legal solutions to this problem. Primary, secondary, and tertiary data were combined to investigate this issue. Population and sample approaches were used to answer research questions. This research analyzed the effectiveness of criminal and non-criminal policies in dealing with defamation in the digital world, providing important insights for future regulatory improvements.en_US
