Abstract: Fenomena kekerasan dalam lembaga Pendidikan sering terjadi di Indonesia. Pemberian hukuman oleh guru dianggap sebagai suatu tindak pidana kekerasan terhadap Peserta Didik. Permasalahan dalam penelitian ini delik materil dan formil terhadap guru yang melakukan tindak pidana kekerasan peserta didik di lingkungan sekolah; Pertanggungjawaban pidana terhadap Guru yang melakukan tindak pidana kekerasan peserta didik di lingkungan Sekolah; Pertimbangan Hakim terhadap Guru yang melakukan tindak pidana kekerasan peserta didik di lingkungan sekolah dalam putusan tersebut. Jenis penelitian ini menggunakan penelitian yuridis normatif. Teknik pengumpulan data yang dipakai penelitian kepustakaan dan penelitian lapangan. Sifat penelitian ini adalah kualitatif. Hasil penelitian delik Materil bahwa akibat dari perbuatan oknum guru terhadap siswanya dengan memakai kekerasan dapat menimbulkan kerugian fisik maupun terganggunya psikologisnya. Delik formil oknum Guru yang melakukan kekerasan terhadap siswanya dengan memukul, menampar disalahkan atau tidak dapat dibenarkan. Berdasarkan Pasal 80 ayat (1) Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak Jo Undang-undang Nomor 35 Tahun 2014 tentang perubahan atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. Disimpulkan tidak ada alasan pembenar tindakan Guru melakukan kekerasan terhadap peserta didik, meskipun karena alasan penegakan disiplin di sekolah. Karena perbuatan kekerasan yang dilakukan oleh Guru terhadap peserta didik dapat berdampak pada perkembangan psikis peserta didik. The phenomenon of violence in educational institutions often occurs in Indonesia. Teachers giving punishment is considered a criminal act of violence against students. The problems in this research were material and formal offenses against teachers who committed criminal acts of violence to students in the school environment, Criminal liability for teachers who committed criminal acts of violence to students in the school environment, The judge's consideration of teachers who committed criminal acts of violence to students in the school environment in that decision. This type of research used normative juridical. Data collection techniques used, were library and field research. The nature of this research was qualitative. The research results on Material offenses showed that the consequences of individual teachers' actions against their students using violence could cause physical harm and psychological disturbance. The Formal Offense of a teacher who committed violence to his students by hitting or slapping was blamed or could not be justified. Based on Article 80 paragraph (1) of Law Number 23 of 2002 concerning Child Protection in conjunction with Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection, it was concluded that there was no reason to justify the teacher's actions in committing violence to students, even if it was for reasons of enforcing discipline at school. This is because acts of violence committed by teachers to students can impact students' psychological development.
