Abstract: | Putusan pengadilan anak yang sering memvonis anak sebagai penyalahguna narkotika dengan hukuman penjara tidak sesuai dengan filosofi dasar peradilan pidana bagi anak. Sanksi pidana mungkin bisa menjadi pilihan terakhir (Ultimum Remedium) apabila cara lain dianggap tidak mampu mengatasinya. Anak-anak yang terlibat kasus hukum seperti penyalahgunaan narkotika tidak sepenuhnya merupakan pelaku dan penjahat yang mungkin akan dihukum seperti orang dewasa; mereka juga merupakan korban yang tidak bisa bertanggung jawab penuh atas perbuatannya. Putusan Pengadilan Negeri Medan Nomor 37/Pid.Sus- Anak/2022/PN Mdn tidak menganggap Undang-Undang Sistem Peradilan Pidana Anak/Sistem Peradilan Pidana Anak (SPPA) melanggar nilai keadilan dan asas kepentingan terbaik bagi anak. Penelitian ini bertujuan untuk mengetahui penerapan asas Ultimum Remedium pada anak penyalahguna narkotika. Penelitian ini menggunakan metode penelitian hukum normatif yang disebut penelitian hukum kepustakaan atau penelitian yang memperhatikan kepustakaan (data sekunder). Hasil penelitian menunjukkan bahwa penerapan asas Ultimum Remedium kepada anak merupakan upaya terakhir dalam menjatuhkan hukuman. The juvenile court decisions that often sentence children to prison as narcotics abusers were not following the basic philosophy of criminal justice for children. Criminal sanctions might be a last resort (Ultimum Remedium) if other methods are considered unable to overcome them. The children involved in legal cases such as narcotics abuse were not entirely perpetrators and criminals who might be punished like adults; they are also victims who cannot be fully responsible for their actions. Medan District Court Decision Number 37/Pid.Sus-Anak/2022/PN Mdn did not consider the Law of Juvenile Criminal Justice System/Sistem Peradilan Pidana Anak (SPPA) to have violated the values of justice and the principle of the children's best interests. This research aimed to find out the application of the Ultimum Remedium principle to children who abuse narcotics. The research used the normative legal research method called library legal research or research that was noticed in the literature (secondary data). The study results showed that the Ultimum Remedium principle implementation to children was the last resort in imposing a sentence. |
