Abstract: Undang-Undang perlindungan anak merupakan upaya pemerintah memberikan bantuan hukum kepada anak yang tersandung pidana. Setiap anak harus mendapatkan perhatian khusus dari pemerintah selama menjalai hukuman di Lembaga Pemasyarakatan. Adapun jaminan anak ini adalah mendapatkan remisi atau pengurangan hukuman, sebagaimana anak terpidana peyalahgunaan narkotika diKota Binjai. Penulis menggunakan metode penelitan yuridis empiris. Hasil penelitian dari penerapan remisi di Lembaga Pemasyarakatan Kelas IIA Binjai sesuai Keppres Nomor 174 Tahun 1999 tentang Remisi dan Keppres Nomor 93 Tahun 2000 tentang Remisi. Remisi anak narapidana narkotika harus memperhatikan Undang-Undang Perlindungan Anak. Lembaga Pemasyarakatan Kelas IIA Binjai pada pokoknya tidak dapat memberikan remisi kepada anak narapidana narkotika, melainkan melimpahkannya kepada Lembaga Pembinaan Khusus Anak, yang berwenang memberikan remisi, syarat mendapatkan remisi ditentukan berdasarkan sidang Tim Pengamat Pemasyarakatan. Hasil sidang tersebutlah seorang anak dapat atau tidak diberikan remisi berdasarkan kelakuan dan masa hukumannya. Kendala yang dihadapi adalah mengenai kelengkapan administrasi serta perilaku anak yang tidak kunjung membaik. Dapat disimpulkan pemberian remisi kepada narapidana anak narkotika harus sesuai dengan peraturan perundang-undangan, dengan memenuhi seluruh syarat. The child protection law is the government's effort to provide legal assistance to children who are involved in crimes. Every child must receive special attention from the government while serving his sentence in a correctional institution. The guarantee for this child is to receive remission or a reduced sentence, like children convicted of narcotics abuse in Binjai City. The author uses empirical juridical research methods. Research results from the implementation of remissions at the Binjai Class IIA Correctional Institution in accordance with Presidential Decree Number 174 of 1999 concerning Remissions and Presidential Decree Number 93 of 2000 concerning Remissions. Remission of children of narcotics convicts must take into account the Child Protection Law. The Binjai Class IIA Correctional Institution is basically unable to grant remissions to children of narcotics convicts, but delegates them to the Special Child Development Institution, which has the authority to grant remissions. The conditions for obtaining remissions are determined based on a session of the Correctional Observer Team. The result of the trial is that a child may or may not be given remission based on his behavior and the period of his sentence. The obstacles faced are related to administrative completeness and children's behavior which does not improve. It can be concluded that granting remission to juvenile narcotics prisoners must be in accordance with statutory regulations, by fulfilling all the requirements.
