Abstract: Putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 menetapkan norma baru yaitu penetapan tersangka berdasarkan alat bukti sebagai objek perkara praperadilan salah satunya putusan Nomor 41/Pid.Pra/2022/PN Mdn yang objeknya adalah Penetapan Tersangka oleh Kepolisian Daerah Sumatera Utara terhadap materi pengujian tersebut hanya menilai aspek formil yaitu apakah terdapat 2 (dua) alat bukti yang sah dan tidak masuk kedalam materi pokok perkara. Permasalahan difokuskan terhadap bagaimana implikasi hukum terhadap Penetapan Tersangka sebagai objek Praperadilan dengan mengkaitkan dengan pertimbangan hakim putusan Nomor 41/Pid.Pra/2022/PN Mdn dan menilai kewenangan hukum oleh pengadilan untuk mengadili perkara praperadilan yang objeknya adalah penetapan tersangka. Jenis penelitian hukum yang digunakan adalah yuridis normatif. Hasil penelitian menunjukkan bahwa timbulnya norma baru terhadap objek perkara Praperadilan khususnya Penetapan Tersangka berdasarkan alat bukti belum mengakomodir jaminan terhadap Hak Asasi Manusia sebagaimana tujuan dibentuknya Lembaga Praperadilan. Ketidakpastian terhadap kewenangan dan prosedur permohonan perkara yang ada, praperadilan dianggap belum mengakomodir jaminan perlindungan upaya paksa terhadap penetapan tersangka oleh aparat penegak hukum yang berakibat timbulnya kerugian Hak Asasi Manusia seseorang. Constitutional Court Decision Number 21/PUU-XII/2014 establishes a new norm where the suspects' determination is based on evidence as the object of the pretrial case. One of which is decision Number 41/Pid.Pra/2022/PN Mdn, the object is the Determination of Suspects by the North Sumatra Regional Police based on that material test. It only assesses the formal aspect, namely whether there are 2 (two) valid pieces of evidence and are not in to the primary material of the case. The problem was focused on the legal implications of determining the suspect as a pretrial object by relating it to the judge's considerations in decision Number 41/Pid. Pra/2022/PN Mdn and assessed the legal authority of the court to try pretrial cases whose object was the determination of a suspect. The type of legal research used was normative juridical. The research results showed that the emergence of new norms regarding the objects of Pretrial cases, especially the determination of suspects based on evidence, had not accommodated guarantees for human rights as intended by the establishment of the Pretrial Institution. Uncertainty regarding the existing authority and procedures for requesting cases, Pretrial was deemed not to accommodate the guarantee of protection against coercive measures against the determination of suspects by law enforcement officials, resulting in detriment to a person's human rights.
