Tinjauan Yuridis Terkait Perbuatan Melawan Hukum Pendirian Bangunan Tanpa Izin di Bantaran Sungai Deli Kecamatan Medan Maimun

Abstract

Pihak atau masyarakat yang mendirikan bangunan diatas Garis Bantaran Sungai Deli dapat dikatakan telah melakukan perbuatan melawan hukum, karena melakukan perbuatan yang bertentangan dengan Peraturan Perundang-Undangan, yang secara jelas melarang pendirian bangunan diatas garis Bantaran sungai kecuali sesuai ketentuan yang telah ditetapkan dan Pemerintah dalam hal ini Pemerintah Daerah sebagai pihak yang dirugiakan karena masyarakat yang mendirikan bangunan di garis Bantaran sungai umumnya tidak memiliki IMB sehingga Pemerintah tidak mendapatkan pemasukan Kas Daerah dan lingkungan akan menjadi korban dari pembangunan digaris Bantaran sungai tersebut. Penelitian ini bertujuan untuk mengetahui Bagaimana Ketentuan-Ketentuan Mengenai Kewajiban Pendirian Bangunan Di Bantaran Sungai Terkait Dengan Tata Ruang, Lingkungan, Dan Ganti Rugi, Bagaimana Perbuatan Melawan Hukum Pemilik Bangunan Yang Mendirikan Bangunan Di Atas Garis Bantaran Sungai Deli Kecamatan Medan Maimun dan Bagaimana Implikasi Penyelesaian Sengketa Perdata Perbuatan Melawan Hukum Pendirian Bangunan Tanpa Izin Di Bantaran Sungai Deli Kecamatan Medan Maimun. Perbuatan Melawan Hukum Pemilik Bangunan Yang Mendirikan Bangunan Garis Bantaran Sungai Deli Kecamatan Medan Maimun bahwa pihak atau dalam hal ini adalah masyarakat yang mendirikan bangunan diatas Garis Sungai Deli Kecamatan Medan Maimun telah melakukan perbuatan melawan hukum, karena melakukan perbuatan yang bertentangan dengan Peraturan Perundang-Undangan, dalam hal ini adalah Perda No. 3 Tahun 2008 tentang bangunan gedung. The reasons for violating, besides economic factors and not having a permanent job, there are also other reasons such as using vacant land, earning a living, and reasons for not having a place to live.
