Abstract: | Pelaksanaan prinsip kehati-hatian dalam rangka pemberian kredit usaha rakyat (KUR) mikro tercermin dalam kriteria yang dinamakan Prinsip 5C. Terdapat 2 rumusan masalah yaitu penerapan prinsip kehati hatian Bank sumut dalam pemberian kredit usaha rakyat (KUR) mikro dan pengaturan hukum dalam pemberian kredit usaha rakyat (KUR) mikro di bank sumut. Tujuan penelitian ini adalah untuk mengetahui Penerapan prinsip kehati-hatian dalam pemberian kredit usaha rakyat (KUR) mikro di BANK sumut, pengaturan hukum dalam pemberian kredit usaha rakyat (KUR) mikro di Bank sumut. Metode penelitian yang digunakan adalah penelitian normatif. Penelitian normatif menggunakan pendekatan perundang-undangan (statute approach). Peneliti menggunakan teknik pengumpulan data dengan cara studi kepustakaan (library research). Studi kepustakaan dilakukan dengan cara mempelajari dan menganalisa secara sistematis bahan hukum yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Hasil penelitian menunjukan Bank Sumut KC Binjai telah menerapkan prinsip kehati-hatian dalam pemberian Kredit Usaha Rakyat (KUR) Mikro kepada calon debitur, pihak Bank Sumut KC Binjai sangat memperhatikan prospek usaha milik calon debitur dikarenakan ketiadaan agunan dalam perjanjian kredit usaha rakyat mikro tersebut. Pengaturan hukum dalam pemberian kredit usaha rakyat (KUR) mikro terdapat dalam Permenko 1 Tahun 2023 tentang pedoman pelaksanaan KUR. The prudential principle implementation in the context of providing micro people's business credit (KUR) is reflected in the criteria called the 5C Principles. There are 2 (two) problem formulations, namely the application of the prudential principle of Bank Sumut in providing micro people's business credit (KUR) and legal regulations in providing micro people's business credit (KUR) at Bank Sumut. This research aimed to determine the application of the prudential principle in providing micro people's business credit (KUR) at Bank Sumut and legal regulations in providing micro people's business credit (KUR) at Bank Sumut. The research method used was normative research. Normative research used a statutory approach. The researcher used data collection techniques employing library research. The literature study was carried out by systematically studying and analyzing legal materials, consisting of primary and secondary legal materials. The research result showed that Bank Sumut of Binjai Branch Office had implemented the prudential principle in providing micro People's Business Credit (KUR) to prospective debtors, which was very concerned about the business prospects of prospective debtors due to the absence of collateral in the micro people's business credit agreement. Legal regulations in providing micro people's business credit (KUR) were contained in Coordinating Ministerial Decree No. 1 of 2023 concerning guidelines implementation of KUR. |
