Kebijakan Kriminal Terhadap Kejahatan Begal Di Wilayah Hukum Polsek Medan Barat

Abstract

Aksi pembegalan yang sering terjadi di wilayah hukum Polsek Medan Barat, begitu meresahkan masyarakat, hal ini disebabkan karena pelaku pembegalan tidak hanya mengancam harta benda saja, akan tetapi juga dapat mengancam keselamatan nyawa para korban. Pada tahun 2020 telah terjadi peristiwa tindak pidana pembegalan telah terjadi di wilayah kecamatan Medan Barat, dengan modus penyerempet korban dan mengancam untuk membunuh korban, apabila korban tidak menyerahkan sepeda motor miliknya. Dari maraknya aksi kejahatan begal tersebut maka Polsek Medan Barat, telah melakukan beberapa upaya dalam hal ini guna pencegahan dan atau menanggulangi tindakan pidana begal, khususnya di wilayah hukum Polsek Medan Barat. Adapun tindak pidana begal di dalam KUH-Pidana, dikategorikan sebagai pencurian dengan pemberatan (curas) yang diatur pada sesuaial 365 di KUHP. Adapun Rumusan masalah dalam penulisan ini adalah, bagaimana faktor-faktor penyebab terjadinya kejahatan begal di polsek medan barat?, dan bagaimana kebijakan kriminal yang dilakukan oleh kepolisian sektor medan barat berkenaan kejahatan begal?. Sedangkan penelitian ini bertujuan guna mengetahui kebijakan-kebijakan yang diambil oleh Polsek Medan Barat dalam penanganan tindak kriminal begal dan faktor apa saja yang memengaruhi pelaku untuk melakukan tindakan kriminal tersebut. Adapun jenis penelitian yang digunakan adalah jenis penelitian sekunder yang sifat kualitatif deskriptif, guna diarahkan dalam menganalisis mengenai kebijakan yang di ambil oleh Polsek Medan Barat dalam penanganan tindak kejahatan begal di wilayah Kecamatan Medan Barat, Kota Medan. Berdasarkan hasil penelitian ini, bahwa faktor-faktor yang memengaruhi tindak pidana begal antara lain diakibatkan oleh: (a) faktor Internal, seperti tingkat pendidikan, agama, dan kognitif; (b) faktor ekstenal, seperti tingkat ekonomi, pengangguran, pergaulan, kecanduan Narkoba dan perjudian. Sedangkan kebijakan yang diambil oleh Polsek Medan Barat dengan melakukan upaya pencegahan dan penindakan seperti melakukan patroli secara terus-menerus dan sosialisasi. Kepolisian Sektor Medan Barat, dalam hal ini berkewajiban atas wilayah hukum kecamatan Medan Barat, Kota Medan, hal ini seperti tertuang dalam wewenang kepolisian yang tertuang di Undang-undang Nomor 2 Tahun 2002, maka Polsek Medan Barat mempunyai wewenang dalam upaya mengendalikan dan menindak aksi-aksi kriminal yang terjadi di wilayah Kecamatan Medan Barat, Kota Medan, sehingga diperlukannya kebijakan yang tepat dan efisien. The acts of mugging that often occur within the jurisdiction of the Polsek Medan Barat, are so disturbing to the community, this is because the perpetrators of the robbery not only threaten property, but also threaten the safety of the lives of the victims. In 2020 the crime of burglary occurred in the Medan Barat subdistrict, with the mode of grazing the victim and threatening to kill the victim if the victim did not hand over his motorbike. From the rampant acts of robbery, the Polsek Medan Barat made several efforts in terms of preventing and overcoming criminal acts of robbery, especially in the jurisdiction of Polsek Medan Barat. As for the crime of robbery in the KUH-Pidana, it is categorized as theft by weighting which is regulated in article 365 of the KUHP. The formulation of the problem in this paper is what are the factors that cause the occurrence of robbery crimes in the Polsek Medan Barat?, and what about the criminal policy carried out by the Polsek Medan Barat against robbery crimes?. While this study aims to find out the policies taken by the Polsek Medan Barat in handling robbery crimes and what factors influence the perpetrators to commit these criminal acts.The type of research used is a type of secondary research which is descriptive qualitative in nature to be directed at analyzing the policies taken by the Polsek Medan Barat in handling robbery crimes in the Medan Barat sub-district,Medan City.Based on the results of this study, the factors that influence the crime of robbery are caused by: (a) internal factors, such as educational, religious, and cognitive levels; (b) external factors, such as economic level, unemployment, association, drug addiction and gambling.While the policy taken by the Polsek Medan Barat is to carry out prevention and prosecution efforts such as conducting continuous patrols and outreach. The Polsek Medan Barat, in this case is responsible for the jurisdiction of Medan Barat sub-district, Medan City, this is as stated in the authority of the police according to Undang--undang Nomor 2 tahun 2002, the Polsek Medan Barat has the authority to attempt prevention and action against criminal acts that occurred in the Medan Barat District, Medan City, so that appropriate and efficient policies are needed.
