Pelanggaran Hak Cipta terhadap Penggandaan Buku yang diperjual Belikan di E-Commerce di Medan

Abstract

Hak Cipta yang melekat pada pencipta berbeda dari hak kekayaan intelektual lainnya, karena yang melekat terdiri dari dua jenis hak, yaitu hak moral (moral rights) dan hak ekonomi. Maraknya pelanggaran hukum hak cipta buku yang diperjualbelikan melalui e-commerce di kota Medan, dan minimnya penegakan hukum secara in action mengakibatkan kerugian pada penulis, penerbit dan konsumen buku, maka masalah dalam penelitian ini dapat dirumuskan sebagai berikut: 1. Bagaimana pengaturan hukum hak cipta buku yang diperjualbelikan di e-commerce 2. Bagaimana bentuk pelanggaran hak cipta buku yang di perjualbelikan di e-commerce di Kota Medan 3. Bagaimana kendala dalam perlindungan hukum hak cipta buku yang diperjualbelikan di e-commerce di Kota Medan. Peneneltian Hukum Normatif-Empiris dipilih sebagai metode, guna mendapat ketentuan hukum normatif dan penerapannya pada peristiwa hukum tertentu. Hasil Penelitian ini menunjukkan dengan tegas bahwa industri e-commerce belum menerapkan perlindungan yang ketat terhadap pelanggaran hak cipta untuk melindungi karya asli pencipta. Faktor-faktor yang mempengaruhi penegakan hukum atas tindak pidana penggandaan buku yang diperjualbelikan melalui e commerce di kota Medan, yaitu: faktor perundang-undangan, dalam masalah delik aduan, yang dapat mengadu adalah pihak yang merasa dirugikan yaitu pencipta atau Penulis dan Penerbit buku. Untuk itu, disarankan masyarakat dapat lebih mengapresiasi hasil karya khusunya buku dengan tidak melakukan pembelian buku bajakan baik secara langsung maupun melalui platform e-commerce. Disisi lain pemerintah harus bertindak tegas memberantas pelaku pembajakan buku dengan melakukan inspeksi berkala kepada platform e-commerce yang disalahgunakan untuk menjual buku-buku hasil penggandaan tanpa izin penulis dan penerbit buku tersebut serta merubah delik aduan menjadi delik biasa dan merubah frasa pelanggaran menjadi kejahatan. The rise of violations of book copyright laws traded through e-commerce in the city of Medan, and the lack of law enforcement in action resulting in losses to authors, publishers and consumers of books, the problems in this study can be formulated as follows: 1. How is the legal regulation of copyright books traded in e-commerce 2. What is the form of copyright infringement of books traded in e-commerce in Medan City 3. How are the obstacles in legal protection of copyright books traded in e-commerce in Medan City, Normative-Empirical Law research was chosen as a method, in order to obtain normative legal provisions and their application to certain legal events.The results of this study show unequivocally that the e-commerce industry has not implemented strict protections against copyright infringement to protect the original work of creators. Factors that affect law enforcement for the criminal act of copying books traded through e-commerce in the city of Medan, namely: statutory factors, in the matter of complaint offenses, who can complain are parties who feel aggrieved, namely the creator or author and publisher of the book. For this reason, it is recommended: People can better appreciate the work of especially books by not buying pirated books either directly or through e-commerce platforms. On the other hand, the government must act decisively to eradicate perpetrators of book piracy by conducting periodic inspections of e-commerce platforms that are misused to sell duplicated books without the permission of the author and publisher of the book and change the offense into ordinary offense and change the phrase offense to crime.
