dc.description.abstract | Perjanjian kerja waktu tertentu (PKWT) adalah perjanjian kerja antara pekerja/ dengan pengusaha untuk mengadakan hubungan kerja dalam waktu tertentu atau untuk pekerjaan tertentu hal ini diatur dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Pekerja PKWT juga memiliki potensi melanggar Perjanjian yang disepakati, yang disebut sebagai tindakan wanprestasi/ yang dapat merugikan perusahaan. Permasalahan dalam penelitian ini adalah bagaimana akibat hukum atas pemutusan hubungan kerja secara sepihak yang dilakukan oleh Yayasan Pendidikan Nasional Khalsa Medan terhadap pekerja yang melakukan tindakan wanprestasi terhadap perjanjian kerja waktu tertentu yang telah disepakati, dan bagaimana penyelesaiannya. Metode penelitian yang digunakan adalah penelitian kepustakaan (Library Research),Penelitian lapangan (Field Research) yaitu penulis langsung melakukan studi pada Yayasan Pendidikan Nasional Khalsa Medan dengan mengambil data yang berhubungan dengan judul skripsi, serta melakukan wawancara kepada pihak terkait. Hasil penelitian menjelaskan faktor yang menyebabkan pihak yayasan pendiidikan nasional Khalsa medan melakukan phk secara sepihak terhadap guru, Pemecatan yang dilakukan sepihak haruslah melalui tahap penyelesaian sengketa phk untuk memastikan perilndungan hukum kepada tenaga kerja, Adapun akibat hukum yang diperoleh guru mendapatkan uang ganti rugi masa kerja yang diperoleh dari Yayasan Pendidikan Nasional Khalsa Medan A specified time work agreement (PKWT) is a work agreement between workers/labourers and employers to enter into a working relationship for a certain time or for a certain job. This is regulated in Law Number 13 of 2003 concerning Manpower and Law Number 11 of 2020 concerning Copyright Work. PKWT workers also have the potential to violate the agreed Agreement, which is also known as an act of default/breaking a promise that can harm the company. The problem in this research is what are the legal consequences for unilateral termination of employment carried out by the Khalsa Medan National Education Foundation for workers who default on work agreements for a certain time that have been agreed upon, and how to resolve them. The research method used was library research (Library Research), field research (Field Research), namely the author directly conducted a study at the Khalsa Medan National Education Foundation by collecting data related to the thesis title, and conducting interviews with related parties. The results of the study explain the factors that caused the Khalsa Medan National Education Foundation to unilaterally lay off teachers, unilateral dismissals must go through the layoff dispute settlement stage to ensure legal protection for the workforce, as for the legal consequences obtained by the teacher getting the right to compensation for years of service obtained from the Khalsa Medan National Education Foundation | en_US |
