Abstract: | Teknologi informasi dan komunikasi merubah perilaku manusia secaraglobal. Peningkatan inovasi teknologi informasi data dan korespondensimempengaruhi perubahan sosial, ekonomi, budaya secara cepat. Data pribadi terdiri dari foto, KTP, akta kelahiran, nomor handphone, email. Penyalahgunaan data pribadi merupakan perbuatan pidana seperti pencurian dan penipuan serta lainnya dari sisi unsur objektif subjektif.Rumusan masalah penelitian ini bagaimana pengaturan hukum tindak pidana penyalahgunaan data pribadi dalam transaksi (online) dalam hukum positif Indonesia, bagaimana penerapan hukum oleh Hakim tindak pidana penyalahgunaan data pribadi putusan No. 541/Pid.Sus/2022/PN Mdn. Metode penelitian yang digunakan yuridis normatif,data primer, sekunder, tersier. Teknik pegumpulan data studi dokumen yaitu melakukan penelitian kepustakaan.Hasil penelitian Pengaturan terkait perlindungan data pribadi Undang Undang No. 19 Tahun 2016 Informasi Transaksi Elektronik, Undang-Undang No. 27 Tahun 2022 Perlindungan Data Pribadi, Penerapan hukum pidana terhadap tindak pidana penyalahgunaan data pribadi No.541/Pid.Sus/2022/PNMdn analisis hukum penulis sesuai hukum KUHPidana menjatuhkan pidana 2 tahun 6 bulan Pasal 51 (1) Jo Pasal 35 Undang-Undang No.19 tahun 2016 tentang InformasiTransaksi Elektronik Jo Pasal 55 ayat (1) ke-1 KUHPidana Information and communication technology is changing human behavior globally. Increasing innovation in data and correspondence information technology influences rapid social, economic, and cultural changes. The Personal data consists of photos, ID Cards, birth certificates, cellphone numbers, and emails. Personal data misuse is a criminal act such as theft, fraud, and others in terms of the objective-subjective elements. The formulations of this research problem were what legal regulation of the criminal act of personal data misuse in online transactions in the positive law of the Republic of Indonesia and how the Judge applied the law for the criminal act of personal data misuse in decision No. 541/Pid.Sus/2022/PN Mdn. The research method used was normative juridical using primary, secondary, and tertiary data. The document study data collection technique was conducted in library research. The research results were Regulations related to Personal Data Protection in Law No. 19 of 2016 Electronic Transaction Information, Law No. 27 of 2022 concerning Personal Data Protection, and Application of penal code to criminal acts of personal data misuse in No.541/Pid.Sus/2022/PN Mdn that the author's legal analysis following the Criminal Code law imposed a sentence of 2 (two) years and 6 (six) months based on Article 51 (1) in conjunction with Article 35 of Law No. 19 of 2016 concerning Electronic Transaction Information in conjunction with Article 55 paragraph (1) 1 of the Criminal Code. |
