Abstract: | Perdebatan kerja mungkin dapat menimbulkan beberapa masalah dalam hubungan modern, seperti perdebatan, pemogokan, dan tidak jarang diakhiri dengan pemutusan hubungan kerja (PHK) oleh para manajer. Setiap individu yang memiliki keberatan dilarang oleh peraturan untuk melakukan aktivitas sendirian tanpa bantuan dari para ahli. Permasalahan dalam penelitian ini adalah bagaimana perlindungan hukum terhadap karyawan yang mengalami pemutusan hubungan kerja berdasarkan undang-undang ketenagakerjaan dan bagaimana pertimbangan hakim dalam mengadili perkara pada putusan nomor 354/Pdt.Sus-PHI/2021/PN Mdn.Jenis penelitian yang digunakan adalah yuridis normatif. Teknik pengumpulan data yang digunakan yaitu metode studi pustaka (library research) dan metode studi lapangan (field research). Hasil penelitian adalahperlindungan hukum bagi karyawan yang mengalami PHK sepihak yaitu sesuai Pasal 168 ayat (3) Peraturan Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan yang menjadi pertimbangan Majelis Hakim adalah fakta-fakta yang ditemukan dipersidangan, seperti alat bukti surat dan keterangan para. Saran yang diberikan adalah Setiap pekerja harus bisa memahami peraturan-peraturan tentang ketenagakerjaan dan perjanjian kerja yang disepakati, sehingga pekerja mengetahui setiap akibat yang terjadi jika pekerja melanggar peraturan dan Majelis Hakim menjatuhkan putusan harus memperhatikan setiap fakta-fakta di persidangan dan ketentuan hukum yang berlaku, sehingga tidak terjadi putusan yang tidak sesuai dengan ketentuan peraturan perundang-undangan yang berlaku. Workplace disputes may lead to several problems in modern relationships, such as arguments, strikes, and not infrequently termination by managers. Any individual who has an objection is prohibited by regulation to carry out activities alone without the help of experts. The problem in this study is how the legal protection of employees who experience termination of employment based on labor law and how the judge's consideration in adjudicating the case in decision number 354/Pdt.Sus PHI/2021/PN Mdn.The type of research used is normative juridical. The data collection techniques used are the library research method and the field research method. The result of the research is legal protection for employees who experience unilateral layoffs, namely in accordance with Article 168 paragraph (3) of Regulation Number 13 of 2003 concerning Manpower and the consideration of the Panel of Judges is the facts found in court, such as letter evidence and testimony.The suggestions given are that every worker must be able to understand the regulations regarding labor and the agreed work agreement, so that workers know every consequence that occurs if workers violate the rules and the Panel of Judges making decisions must pay attention to every fact in the trial and the applicable legal provisions, so that there are no decisions that are not in accordance with the provisions of the applicable laws and regulations. |
