Abstract: Pendistribusian melalui pengangkutan Bahan Bakar Minyak yang di subsidi pemerintah Indonesia untuk kepentingan masyarakat banyak, sering terjadi penyelewengan oleh oknum dan sekolompok masyarakat yang tidak bertanggungjawab. Pasal 55 Undang-Undang Republik Indonesia No 22 Tahun 2001 Tentang Minyak dan Gas Bumi, Adapun permasalahan dalam penelitian ini adalah bagaimana bentuk penyalahgunaan pengangkutan bahan bakar minyak tanpa dilengkapi izin dan Bagaimana pertanggungjawaban pidana pengangkutan bahan bakar minyak tanpa dilengkapi izin Berdasarkan Putusan 1819/Pid.sus/2020/Pn. Mdn. Metode yang digunakan adalah metode Yuridis Normatif, Jenis data yang digunakan penelitian ini ialah Jenis data Sekunder. Teknik pengumpulan data dilakukan dengan dua cara, pertama penelitian studi kepustakaan (library Research), dan kedua penelitian studi lapangan (field research). Penelitian ini menggunakan analisa data secara deskriptif. Hasil penelitian ditemukan bahwa Bentuk Penyalahgunaan Pengangkutan Bahan Bakar Minyak berupa Alat angkut yang digunakan dalam pengangkutan tidak memenuhi standar. Pengemudi yang menjalankan armada tidak memiliki izin usaha pengangkutan melalui Menteri Energi dan Sumber Daya Mineral. Pertanggungjawaban pidana pengangkutan bahan bakar minyak subsidi bio solar tanpa izin bahwa Pelaku telah memenuhi unsur-unsur Pertanggungjawaban Pidana, Terdakwa mengakui kesalahan dan mohon untuk dijatuhi pidana yang seringan-ringannya, sehinnga Majelis Hakim menjatuhkan Pidana Penjara selama 1 (satu) tahun. The distribution through the subsidized fuel oil transportation by the government of the Republic of Indonesia for the general public interest often involves fraud by irresponsible individuals and groups of people. Transporting fuel oil without a permit is regulated in Article 55 of the Law of the Republic of Indonesia No. 22 of 2001 concerning Oil and Natural Gas. The problems in this research were what kind of misuse was for transporting fuel oil without a permit and what criminal liability was for transporting fuel oil without a permittance based on Decision 1819/Pid.sus/2020/Pn.Mdn. The method used was the Normative Juridical. The type of data used in this research was secondary data type. Data collection techniques were carried out in two procedures: the first, library research, and the second, field research. This research used descriptive data analysis. The results found that the kinds of misuse for transporting fuel oil without a permit were non standard transportation usage, and drivers who ran the vehicles did not have a transportation business permit through the Minister of Energy and Mineral Resources. Thus, the criminal liability for transporting subsidized bio-diesel fuel oil without a permittance that the perpetrator had fulfilled the elements of criminal liability. The defendant admitted his mistake and asked to be sentenced to the lightest possible punishment so that the Panel of Judges imposed a prison sentence of 1 (one) year.
