Abstract: | Dalam Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan. Pada kenyataannya masih banyak orang yang melakukan pelanggaran lalu lintas, baik dari pengguna jalan maupun penegak hukumannya sendiri, yang mengakibatkan gangguan pada ketertiban umum, kerugian dan kematian. Berdasarkan uraian di atas, maka permasalahan yang dirumuskan adalah bagaimana pengaturan hukum lalu lintas terhadap kecelakaan lalu lintas di wilayah hukum Polres Binjai, bagaimana peran kepolisian dalam penegakan hukum terhadap kecelakaan lalu lintas di Polres Binjai, dan apakah yang menjadi kendala dalam penegakan hukum lalu lintas di Polres Binjai. Metode yang digunakan dengan pendekatan normatif dan pendekatan empiris. Lokasi penelitian dilakukan di Polres Binjai, sumber data yang diperoleh dari bahan hukum primer, sekunder dan wawancara dengan informan kunci. Analisi data menggunakan metode kualitatif dengan deskriptif analisi kemudian ditarik dalam sebuah kesimpulan. Hasil penelitian menunjukkan bahwa pengaturan hukum lalu lintas diatur dalam Undang-Undang Nomor 29 Tahun 2009, KUHAP dan dalam peraturan kepolisian Nomor 15 tahun 2013 tentang cara penanganan kecelakaan lalu lintas. Peran kepolisian dalam penegakan hukum kecelakaan lalu lintas dilakukan melalui mediasi antara keluarga korban dengan keluarga pelaku dengan cara bermusyawarah yang dipandu oleh pihak kepolisian. Kendala yang dihadapi adalah jika korban meninggal dunia, In Law Number 22, 2009 concerning to Road Traffic and Transportation. In reality, there are still many people who commit traffic violations, both from road users and law enforcers themselves, which makes a disruption to public order, losing and death. Based on the description above, the problem formulated is that how to regulate traffic law on traffic accidents in the jurisdiction of Binjai Police Station, what is the role of the police in law enforcement against traffic accidents at Binjai Police Station and what are the obstacles in enforcing traffic law in Binjai Police Station. The method used is a normative approach and the empirical approach. The location of the research was carried out at Binjai Police Station, the source of data was obtained from primary and secondary legal materials and interviews with key informants. Data analysis used is qualitative method with descriptive analysis and then a conclusion was described. The results of the study show that traffic law arrangements are regulated in Law Number 29, 2009, the Criminal Procedure Code and in police regulations Number 15, 2013 concerning how to handle traffic accidents. The role of police in enforcing the law on traffic accidents is carried out through mediation between the families of the victims and the families of the perpetrators in a deliberative manner guided by the police. The obstacle faced is that if the victim dies, it is difficult for the victim's family to make peace, and even the perpetrator is sentenced in to prison. |
