Abstract: Permasalahan yang sering timbul dalam perjanjian kredit dapat dikatakan sebagai perbuatan melawan hukum yang dapat merugikan seseorang atau kegagalan salah satu pihak yaitu konsumen atau debitur untuk melaksanakan perjanjian. Penelitian ini bertujuan untuk mengetahui penyelesaian apabila terjadi wanprestasi dalam pelaksanaan kredit pada perjanjian jual beli kendaraan bermotor jenis mobil, untuk mengetahui tanggung jawab hukum atas perbuatan melawan hukum terhadap perjanjian kredit kendaraan bermotor jenis mobil. Metodologi pada penelitian ini yaitu, jenis penelitian yuridis normatif, yang bersifat deskriptif analitis, teknik pengumpulan data berupa wawancara, studi kepustakaan dan dokumentasi, analisis data pada penelitian ini adalah kualitatif. Hasil penelitian menunjukkan bahwa ganti rugi akibat wanprestasi telah diatur pada Pasal 1246 KUHPerdata. Untuk masalah penyelesaian biasanya pihak dealer menggunakan dua cara yaitu dengan musyawarah mufakat (non litigasi) dan dengan gugatan pengadilan (litigasi). Tanggung jawab hukum atas perbuatan melawan hukum terhadap perjanjian kredit kendaraan bermotor jenis mobil pada PT. Mandiri Utama Finance yaitu debitur dimintai pertanggungjawaban secara hukum dengan mengembalikan jaminan fidusia yang merupakan hak milik atas barang yang hak kepemilikannya masih berada di bawah penguasaan pemilik barang. Problems that often arise in credit agreements can be considered unlawful acts that can harm someone or the failure of one of the parties, namely the consumer or debtor, to carry out the covenant. This research aimed to determine the resolution of whether there was a default in the implementation of credit in a cartype motor vehicle sale and purchase agreement and to determine legal liability for unlawful acts on a car-type motor vehicle credit agreement. The methodology in this research was normative juridical research, which was descriptiveanalytical; data collection techniques were in the form of interviews, literature studies, and documentation; and the data analysis in this research was qualitative. The research results showed that compensation due to default had been regulated in Article 1246 of the Civil Code. To resolve problems, dealers used two methods. They were by deliberation to reach a consensus (nonlitigation) and by court lawsuit (litigation). Thus, the legal liability for unlawful acts regarding car-type motor vehicle credit agreements at PT Mandiri Utama Finance, in which the debtor was held legally accountable by returning the fiduciary guarantee that the ownership right to goods whose ownership rights were still under the control of the owner of the goods.
