Abstract: Penyimpangan tingkah laku atau perbuatan melanggar hukum yang dilakukan oleh anak disebabkan oleh berbagai faktor antara lain dampak negatif dari perkembangan pembangunan yang cepat, arus globalisasi di bidang komunikasi dari informasi, serta kemajuan ilmu pengetahuan. Menurut Pasal45 Kitab Undang-Undang Hukum Pidana, anak yang belum dewasa adalah apabila belum berumur 16 tahun. Adapun tujuan penelitian dan penulisan yang dilakukan penulis untuk mengetahui Penerapan sanksi pidana terhadap anak sebagai pelaku kejahatan penganiayaan berat yang mengakibatkan kematian, untuk mengetahui kendala yang menjadi penghambat dalam penerapan sanksi pidana terhadap anak sebagai pelaku kejahatan penganiayaan berat yang mengakibatkan kematian. Metode Penelitian yang digunakan yaitu Penelitian Kepustakaan (Library Research) yaitu metode dengan melakukan penelitian terhadap berbagai sumber bacaan tertulis. Penelitian Lapangan (Field Research) penulis langsung melakukan studi pada Pengadilan Negeri Medan. Analisis Sanksi Pidana Terhadap Anak Sebagai Pelaku Kejahatan Penganiayaan Berat Yang Mengakibatkan Kematian dalam Putusan Pengadilan Negeri Medan No.5/Pid.sus- Anak/2022/PN.Mdn yakni menerapkan sanksi pidana penjara kepada anak oleh karena itu dengan pidana penjara selama 3 (tiga) tahun 6 (enam) bulan. Various factors cause deviant behavior or unlawful acts committed by children. It includes the negative impact of rapid development, the flow of globalization in information communication, the advances in science and technology, and the changes in parenting styles and lifestyles. Based on Article 45 of the Criminal Code, a child who has not reached the age of majority is a person who has not reached the age of 16. If a child is involved in a criminal case, the judge may order that the minor defendant be returned to his/her parents. The problemata in this study were the application of criminal sanctions against children as crimes perpetrators of serious abuse resulting in death; the obstacles in implementing criminal sanctions against children as crimes perpetrators of serious abuse resulting in death in the decision; the consideration of judges against children as crimes perpetrators of serious abuse resulting in death in the decision. The type of this research was normative juridical research. The data collection techniques used were library and field research. The nature of this research was qualitative. The results showed that children who committed crimes of abuse were caused by two factors, namely internal and external factors. Based on Law No. 23 of 2002 concerning Child Protection in conjunction with Law No. 35 of 2014 on Amendments to Law No. 23 of 2002 concerning Child Protection, it was concluded that children who committed crimes of serious abuse were subject to imprisonment for 3 (three) years and 6 (six) months.
