dc.description.abstract | Perlindungan hukum terhadap pekerja dimaksudkan untuk menjamin hak dasar dan kesamaan kesempatan serta perlakuan tanpa ada diskriminasi demi mewujudkan kesejahteraan pekerja sesuai UU RI No. 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian bertujuan; mengetahui pengaturan hukum penerapan upah pekerja, pertimbangan hukum hakim, dan bentuk perlindungan hukum terhadap pelaksanaan pemberian upah minimum dalam Putusan Nomor 349/Pdt.Sus-PHI/2021/PN.Mdn. Penulis menggunakan pendekatan hukum normatif melalui data primer (wawancara) dan data sekunder (buku dan jurnal terkait). Hasil penelitian adalah pengaturan hukum penerapan upah pekerja dalam Putusan Nomor 349/Pdt.Sus-PHI/2021/PN.Mdn adalah Pasal 90 ayat (1) dan Pasal 89 ayat (3) di UU RI No. 13 Tahun 2003 tentang Ketenagakerjaan tertuang di Keputusan Gubernur Sumatera Utara Pada Nomor 188.44/1438/KPTS/2018 Tentang Penetapan Upah Minimum Kabupaten Asahan Tahun 2019, Nomor 188.44/752/KPTS/2019 Tentang Penetapan Upah Minimum Kabupaten Asahan Tahun 2020 dan Nomor 188.44/1005/KPTS/2020 Tentang Penetapan Upah Minimum Kabupaten Asahan Tahun 2021. Pertimbangan hakim dalam Putusan Nomor 349/Pdt.Sus-PHI/2021/PN.Mdn adalah memutuskan menolak gugatan dikarenakan tidak dapat menghadirkan bukti yaitu nota dari Pengawas Ketenagakerjaan terkait kekurangan upah. Bentuk perlindungan hukum terhadap pelaksanaan pemberian upah minimum dalam Putusan Nomor 349/Pdt.Sus- PHI/2021/PN.Mdn adalah Pasal 1 angka 30 UU Ketenagakerjaan berbentuk Perjanjian Kerja Waktu Tidak Tertentu dibuat secara lisan di awal masa kerja dan disahkan melalui putusan majelis hakim. Protection of workers is intended to guarantee the basic rights and equality of opportunity and treatment without discrimination on any basis to realize workers' welfare accordance with Law Number 13 of 2003 Concerning Manpower. The aim of this study; to find out the legal arrangements for applying wages to workers; to find out the judge's legal considerations; to find out the form of legal protection against the implementation of the minimum wage in Decision Number 349/Pdt.Sus-PHI/2021/PN.Mdn. The author uses normative approach law from primary data (interviewing) and secondary data (books and journals). The results is; legal arrangements for applying wages to workers in Decision Number 349/Pdt.Sus-PHI/2021/PN.Mdn is Article 90 paragraph (1) and Article 89 paragraph (3) of RI Law No. 13 of 2003 concerning Manpower contained in The Decree of The Governor of North Sumatra Number 188.44/1438/KPTS/2018 concerning determination of The Asahan District Minimum Wage for 2019, Number 188.44/752/KPTS/2019 concerning determination of The Asahan District Minimum Wage for 2020 and Number 188.44/1005/KPTS/2020 concerning determination of The Asahan District Minimum Wage for 2021. Judge's considerations in Decision Number 349/Pdt.Sus-PHI/2021/PN.Mdn is deciding to reject the plaintiff's claim is unable to present evidence, namely a note from the Labor Inspector regarding the lack of wages. The form of legal protection against the implementation of the provision of minimum wages in Decision Number 349/Pdt.Sus-PHI/2021/PN.Mdn is stated in Article 1 number 30 of the Manpower Law which Unspecified Time Work Agreement made orally at the beginning of the working period and ratified through a decision from the assembly judge. | en_US |
