Abstract: | Pekerjaan merupakan suatu mata pencaharian bagi seseorang atau Masyarakat demi memenuhi kebutuhan hidupnya sehari-hari, Bagi pekerja/buruh pemutusan hubungan kerja (PHK) merupakan hilangnya mata pencaharian, berarti pekerja/buruh kehilangan pekerjaaan dan penghasilan. oleh sebab itu, istilah pemutusan hubungan kerja (PHK) bisa menjadi momok bagi setiap pekerja/buruh karena mereka dan keluarganya terancam kelangsungan hidupnya dan merasakan derita akibat dari Pemutusan Hubungan Kerja (PHK). Dalam penelitian ini rumusan masalah yaitu Bagaimana pengaturan hukum tentang pemutusan hubungan kerja sepihak menurut perjanjian kerja bagaimana prosedur pemutusan hubungan kerja secara sepihak berdasarkan putusan nomor 332/pdt.Sus.PHI/2021/PN Mdn Bagaimana pertimbangan hakim terhadap pemberhentian secara sepihak ditinjau dari putusan nomor 332/pdt.Sus.PHI/2021/PN. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan yang diambil dari data sekunder, data primer dan data tersier. Berdasarkan hasil penelitian bahwa Pengaturan tentang pemutusan hubungan kerja diatur dalam uu no 13 tahun 2003 dan prosedur pemutusan hubungan kerja tertuang pada uu no 20 tahun 2020, akan tetapi, phk sepihak sejatinya dilarang, tetapi pada saat ini sering terjadi pemutusan hubungan kerja secara sepihak. Perlindungan hukum bagi tenaga kerja yang di PHK telah diatur dalam pasal 156 Undang-Undang No.13 Tahun 2003 tentang Ketenagakerjaan. Work is a means of livelihood for a person or community in order to meet their daily needs. For workers/laborers, termination of employment (PHK) is a loss of livelihood, meaning workers/laborers lose jobs and income. therefore, the term termination of employment (PHK) can be a scourge for every worker/laborer because their survival and their families are threatened and suffer the consequences of termination of employment (PHK). In this research, the formulation of the problem is how to regulate the law regarding unilateral termination of employment according to the work agreement, what is the procedure for unilateral termination of employment based on decision number 332/pdt.Sus.PHI/2021/PN Mdn. What is the judge's consideration of unilateral dismissal in terms of decision number 332/pdt. Sus. PHI/2021/PN. The research method used is normative juridical research with a statutory approach taken from secondary data, primary data and tertiary data. Based on the results of the study, the provisions concerning termination of employment are regulated in UU No. 13 of 2003 and the procedure for terminating employment is contained in UU No. 20 of 2020, however, unilateral termination of employment is actually prohibited, but at this time unilateral termination of employment often occurs. Legal protection for workers who are laid off is regulated in article 156 of Law No. 13 of 2003 concerning Employment. |
