Abstract: Perjanjian pengangkutan adalah suatu perjanjian dimana satu pihak menyanggupi untuk dengan aman membawa orang atau barang dari satu tempat ke tempat lain, sedangkan pihak yang lain menyanggupi akan membayar ongkosnya. Menurut sistem hukum Indonesia, pembuatan perjanjian pengangkutan tidak disyaratkan harus tertulis, cukup dengan lisan asal persetujuan kehendak. Pelnellitian ini pelrlul dilakulkan olelh karelna ulntulk melngeltahuli bagaimana pellaksanaan pelrjanjian pelngangkultan bulah kellapa sawit antara PTPN V (Kelbuln Seli Belrlian) delngan PT Satria Sulltan Syaqil, apakah telrdapat hambatan-hambatan sellama prosels pellaksanaan pelngangkultan, siapa yang belrtanggulng jawab terhadap objelk yang diangkult sampai tuljulan, bagaimana hak dan kelwajiban para pihak, dan julga pelnyellelsaian selngkelta antara keldula bellah pihak dalam pelrjanjian pelngangkultan bulah kellapa sawit ini. Masalah yang difokuskan pada Aspek Hukum Perjanjian Pengangkutan Kelapa Sawit oleh PT. Perkebunan Nusantara V (PTPN) V Sei Berlian? Tanggung Jawab PT. Satria Sultan Syaqil dengan PT. Perkebunan Nusantara V (PTPN)V Sei Berlian akibat wanprestasi?. Metode pendekatan yang dipergunakan dalam penyusunan skripsi ini adalah normatif, karena hukum itu diadumsikan sebagai sesuatu yang otonom sehingga keberlakuannya ditentukan oleh hukum itu sendiri bukan oleh faktor-faktor di luar hukum. Apabila kedua belah pihak melanggar berlakunya perjanjian maka kedua belah pihak dikenakan pasal 1266 Kitab Undang-Undang Hukum Perdata sepanjang mengatur tentang pengakhiran perjanjian melalui pengadilan, serta melepaskan ketentuan pasal 1267 Kitab Undang-Undang Hukum Perdata sepanjang mengatur tentang pemberian ganti kerugian dalam bentuk apapun apabila perjanjian ini diakhiri. Hambatan tentu akan dihadapi oleh para pihak dalam pelaksanaan perjanjian, namun untuk meminimalisir hambatan yang bisa terjadi selanjutnya, serta untuk menurunkan resiko ganti rugi atas keterlambatan, rusak, atau hilangnya Tandan Buah Segar(TBS),Kepada perusahaan pengangkutan agar memberikan sosialisasi kepada karyawanya terkait pentingnya mematuhi aturan yang telah dibuat didalam perjanjian. A transportation agreement is in which one party undertakes to safely transportpeople or goods from one place to another, while the other party undertakes to pay the costs. According to the Indonesian legal system, a transportation agreement does not have to be in writing; it can be verbal as long as the will is agreed upon. This research was necessary to find out how the oil palm fruit transportation agreement between PTPN V (Sei Berlian Plantation) and PT Satria Sultan Syaqil was implemented, whether there were any obstacles during the transportation process, who was responsible for the objects being transported to their destination, what the rights and obligations of the parties were, and also how disputes between the two parties in this oil palm fruit transportation agreement were resolved. The problem focused on the Legal Aspects of Oil Palm Transportation Agreements by PT Perkebunan Nusantara V (PTPN) V Sei Berlian and the responsibilities of PT Satria Sultan Syaqil with PT Perkebunan Nusantara V (PTPN) V Sei Berlian due to default. The approach method used in preparing this study was normative because the law was assumed to be autonomous, so its validity was determined by the law itself, not by factors outside the law. If both parties violated the validity of the agreement, then both parties were subject to Article 1266 of the Civil Code, as long as it regulated the termination of the agreement by the court and waived the provisions of Article 1267 of the Civil Code as long as it regulated the provision of compensation in any form if the agreement this ended. The parties would undoubtedly face obstacles in implementing the agreement, but to minimize them that could arise later, as well as to reduce the risk of compensation for delays, damage, or loss of Fresh Fruit Bunches (FFB), transportation companies should educate their employees about the importance of complying with the rules established in the agreement.
