dc.description.abstractHukuman kebiri kimia sendiri berawal dari dorongan dan usul dari Komisi Perlindungan Anak Indonesia (KPAI), Kementerian Sosial, Kementerian Kesehatan, dan Kementrian Pendidikan Nasional. Lembaga-lembaga tersebut beranggapan bahwa hukuman tersebut diharapkan dapat memberikan efek jera yang maksimal bagi pelaku pedofil dan mencegah calon pelaku Pencabulan melakukan hal serupa. Yang menjadi permasalahan dalam skripsi ini yaitu, Bagaimana pertimbangan hakim dalam menjatuhkan pidana tambahan kebiri kimia dalam Putusan Nomor 695/Pid.Sus/2019/PT SBY dan Bagaimana pelaksanaan hukuman pemberatan kebiri kimia terhadap pelaku Tindak pidana pencabulan. Penelitian ini menggunakan jenis penelitian yuridis empiris yang dengan kata lain adalah jenis penelitian hukum sosiologis, serta Wawancara (interview) dengan pihak Pengadilan Negeri di kota Medan yang dianggap mampu menjawab pertanyaan yang berkaitan dengan masalah yang diteliti. Berdasarkan ketentuan Pasal 81 A UU No.17 Tahun 2016 menyebutkan bahwa “tindakan kebiri kimia dan pemasangan alat pendeteksi elektronik pada pelaku kekerasan seksual terhadap anak dikenakan untuk jangka waktu paling lama 2 (dua) tahun dan dilaksanakan setelah terpidana menjalani pidana pokok”. Kebiri kimia sangat efektif terhadap kasus pencabulan dikarenakan sudah banyak korban maupun seorang anak, perempuan, hingga laki-laki yang bisa mengganggu kesehatan psikis maupun kejiwaan korban pencabulan tersebut. The chemical castration penalty itself originated from encouragement and suggestions from the Commission Indonesian Child Protection (KPAI), Ministry of Social Affairs, Ministry Health, and Ministry of National Education. These institutions assume that this punishment is expected to have a deterrent effect maximum for pedophiles and prevent potential perpetrators of sexual abuse from committing it similar thing. The problem in this thesis is, How the judge's consideration in imposing an additional sentence of chemical castration in Decision Number 695/Pid.Sus/2019/PT SBY and How the punishment is implemented chemical castration for perpetrators of criminal acts of sexual immorality. This research uses a type of empirical juridical research, which in other words is a type sociological legal research, as well as interviews with the court The country in the city of Medan is considered capable of answering related questions with the problem under study. Based on the provisions of Article 81 A of Law No.17 2016 stated that “the act of chemical castration and mounting electronic detection tool for perpetrators of sexual violence against children imposed for a maximum period of 2 (two) years and implemented after the convict has served the principal sentence." Chemical castration is very effective against cases of sexual abuse because there are many victims and one child, women, to men, which can harm their psychological and mental health mental state of the victim of abuse.en_US
