Abstract

Pada penelitianini masalah yang difokuskan adalah Bagaimana Pemberlakuan Kebijakan Suspend Terhadap Driver Oleh Perusahaan Gojek. Bagaimana Perlindungan Hukum Terhadap Driver Gojek yang di Suspend. dan Bagaimana Tanggungjawab Hukum Atas Kebijakan Suspend Driver oleh Perusahaan. Metode pendekatan yang dipergunakan dalam penyusunan skripsi ini adalah normatif empiris. Normatif adalah suatu proses prosedur penelitian ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan dari sisi normatifnya. Dikatakan normatif, karena hukum itu diasumsikan sebagai sesuatu yang otonom sehingga keberlakuannya ditentukan oleh hukum itu sendiri bukan oleh faktorfaktor diluar hukum. Sementara itu pendekatan empiris adalah suatu suatu proses prosedur penelitian ilmiah untuk menemukan kebenaran yang dilakukan oleh peneliti dengan suatu pengamatan langsung (observasi) dilapangan terhadap objek penelitian, dimana pada penelitian ini peneliti melakukan wawancara langsung dengan pihak yang berkepentingan terkait dengan tema penelitian. Dalam penerapan dan pelaksanaan kebijakan perusahaan Gojek pada pengenaan sanksi suspend driver yang melanggar Tartibjek. Diketahui berdasarkan aduan/laporan konsumen pengguna jasa Gojek atas kinerja driver yang mengecewakan dan tidak memuaskan pelanggannya. Seperti berlaku tidak tertib berlalu lintas, performa dari personal dari driver itu sendiri dan atau ketidak sesuaian/kesalahfahaman dalam pengantaran barang. Sehingga kinerja buruk driver tersebut mendapatkan penilaian negatif dari konsumen pengguna jasa Gojek, yang pada akhirnya sang driver pun terkena sanksi suspend dari perusahaan Gojek.
