Perlindungan Hukum Bagi Polisi Sebagai Personel Pengamanan dalam Menghadapi Kegiatan Unjuk Rasa Yang Anarkis Di Wilayah Hukum Polrestabes Medan

Abstract

Demonstrasi dan aksi unjuk rasa di Indonesia telah menjadi santapan publik, tidak jarang karena praktiknya tidak sesuai dan menciptakan suasana yang tidak nyaman, biasanya mengakibatkan kekerasan atau penyalahgunaan kekerasan dapat terjadi karena berbagai alasan, termasuk orang-orang di dalam dan di luar demonstran itu sendiri. Peran Polri sebagai aparat keamanan harus ditugasi bagaimana mengembangkan format baru untuk mencegah, menahan, mendisiplinkan, dan mengamankan demonstrasi massa yang tidak terkendali mengingat seringnya bentrokan antara demonstran dan polisi. Permasalahan dalam penelitian ini, yaitu: Bagaimana Perlindungan Hukum Bagi Polisi Sebagai Personel Pengaman Dalam Menghadapi Kegiatan Unjuk Rasa Yang Berlangsung Anarkis serta peranan Polisi dan Kendala yang dihadapi Polisi Mencegah Kerusuhan dalam Demonstrasi di Wilayah Hukum Polrestabes Medan. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris, guna mendapat ketentuan hukum normatif dan penerapannya pada setiap peristiwa hukum tertentu. Hasil penelitian menujukkan beberapa hal: 1. Perlindungan hukum bagi polisi sebagai personel dalam melakukan tindakan yakni No.Pol. Protap/06-RJ/IV/2006, Tentang Pengamanan Unjuk Rasa Damai dan Prosedur tetap No.Pol. : Protap/10-RJ/IV/2006, Tentang Penertiban Unjuk Rasa Yang Menyimpang; 2. Peranan polisi terhadap kegiatan unjuk rasa yang berlangsung anarkis, dengan tindakan proaktif (non-kriminal), tindakan preventif (non-kriminal), dan tindakan represif (kriminal) yang bertujuan untuk menekan suatu kejahatan yang melanggar keamanan dan ketertiban.3. Kendala–kendala yang dihadapi polisi mencegah kerusuhan dalam demonstrasi di wilayah hukum Polrestabes Medan, jumlah massa seringkali tidak tepat, Potensi anarkisme akibat terlalu banyak massa hanya bisa diatasi jika penyelenggara demonstrasi mengurangi jumlah massa, dan Jumlah polisi tidak sebanding. Demonstrations and rallies in Indonesia have become public food, not infrequently because the practices are inappropriate and create an uncomfortable atmosphere, usually resulting in violence or abuse of violence which can occur for various reasons, including people within and outside the demonstrators themselves. The role of the National Police as a security apparatus must be tasked with how to develop new formats to prevent, contain, discipline and secure uncontrolled mass demonstrations considering the frequent clashes between demonstrators and the police. The problems in this research are: What is the legal protection for the police as security personnel in dealing with anarchic demonstration activities as well as the role of the police and the obstacles faced by the police in preventing riots in demonstrations in the jurisdiction of the Medan City Police. The research method used is normative-empirical legal research, in order to obtain normative legal provisions and their application to each specific legal event. The research results show several things: 1. Legal protection for the police as personnel in carrying out actions, namely No.Pol. Protap/06-RJ/IV/2006, Concerning Security of Peaceful Demonstrations and Fixed Procedures No.Pol. : Protap/10-RJ/IV/2006, Concerning Controlling Deviant Demonstrations; 2. The role of the police in anarchic demonstration activities, with proactive (non-criminal) actions, preventive (non-criminal) actions and repressive (criminal) actions aimed at suppressing crimes that violate security and order.3. The obstacles faced by the police in preventing riots during demonstrations in the jurisdiction of the Medan City Police, the number of masses is often incorrect, the potential for anarchism due to too many crowds can only be overcome if the demonstration organizers reduce the number of crowds, and the number of police is not comparable.
