Penerapan Peraturan Kepolisian Nomor 7 Tahun 2022 Terkait Pemberhentian Tidak Dengan Hormat (PTDH) Anggota Polri yang Melanggar Kode Etik Profesi Polri (KEPP) di Polrestabes Medan

Abstract

Menegakkan Etika Profesi Polri maka setiap pimpinan disetiap tingkatan Polri (Polsek, Polres, Polwil, Polda dan Mabes), dituntut mampu memberikan sanksi kepada Anggota Polri yang melakukan pelanggaran melalui Sidang Komisi Kode Etik Profesi (KKEP) maupun Sidang Disiplin. Dalam kasus anggota kepolisian tersebut melakukan pelanggaran kode etik kepolisian karena telah melakukan tindak pidana , maka dari itu anggota polisi tersebut harus mengikuti sidang kode etik, penjatuhan hukuman ganda bagi anggota Polri yang melakukan tindak pidana, yakni menerima sanksi pidana dan juga sanksi hukuman disiplin. Rumusan masalah yang dapat ditarik adalah bagaimana peran kepolisian dalam penegakan kode etik kepolisian dan faktor-faktor apa saja yang menyebabkan PTDH polri di polrestabes medan. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris, guna mendapat ketentuan hukum normatif dan penerapannya pada setiap peristiwa hukum tertentu. Hasil penelitian menujukkan beberapa hal; Peran kepolisian dalam penegakan kode etik kepolisian negara Republik Indonesia dengan dibentuk satuan internal yang bertugas melakukan pengawasan langsung yaitu PROPAM Polri melakukan pemeriksaan pendahuluan terhadap pelanggaran kode etik dengan cara audit investigasi, pemeriksaan, dan pemberkasan oleh fungsi Propam Polri bidang Pertanggungjawaban Profesi serta pengawasan pelaksanaan putusan dan rehabilitasi personel yang telah mendapat putusan hukum yang tetap. Penerapan Peraturan Kepolisian Nomor 7 Tahun 2022 terhadap PTDH yang melanggar Kode Etik Profesi Polri Di Polrestabes Medan telah sesuai dilihat pada Pelanggaran Kode Etik Profesi Polri Nomor: BP3KEPP/43/X/2022/Wabprof/Si Propam terkait kasus pelanggaran yang dilakukan Briptu SRB terhadap penyalahgunaan narkotika jenis sabu, tindak pidana KDRT, dan pemerasan. yang telah dijatuhi hukuman disiplin lebih dari 3 (tiga) kali hingga diberhentikan dengan tidak hormat dari Kepolisian Negara Republik Indonesia. Enforcing Police Professional Ethics means that every leader at every level of the Police (Polsek, Polres, Polwil, Polda and Headquarters), is required to be able to provide sanctions to Polri members who commit violations through Professional Ethics Code Commission (KKEP) hearings and Disciplinary Hearings. In the event that a police member violates the police code of ethics because he has committed a criminal act, the police member must therefore take part in a code of ethics trial. There is a double punishment for members of the National Police who commit a criminal act, namely receiving criminal sanctions and also disciplinary sanctions. The problem formulation that can be drawn is what is the role of the police in enforcing the police code of ethics and what factors influence the implementation of police regulation number 7 of 2022 towards PTdh Polri at the Medan Police Station. The research method used is normative-empirical legal research, in order to obtain normative legal provisions and their application to each specific legal event. The research results show several things; The role of the police in enforcing the code of ethics for the police of the Republic of Indonesia is by forming an internal unit tasked with direct supervision, namely PROPAM Polri, carrying out preliminary examinations of violations of the code of ethics by means of investigative audits, inspections and filings by the Propam Polri function in the field of Professional Accountability as well as supervising the implementation and rehabilitation personnel who have received a permanent legal decision. The implementation of Police Regulation Number 7 of 2022 against PTDH which violates the Police Professional Code of Ethics at Medan Polrestabes is in accordance with the violation of the Police Professional Code of Ethics Number: BP3KEPP/43/X/2022/Wabprof/Si Propam regarding the violation case committed by Brigadier SRB regarding the termination methamphetamine-type narcotics, domestic violence crimes, and extortion. who has been sentenced to disciplinary punishment more than 3 (three) times and was dishonorably terminated by the Indonesian National Police
