Peranan Polri dalam Mengungkap Tindak Pidana Narkotika terhadap Pelajar di Wilayah Hukum Kota Medan

Abstract

Permasalahan penggunaan narkotika yang dilakukan oleh anak merupakan masalah yang sangat serius, mengingat anak meerupakan aset negara dan penerus masa yang akan datang. Peran Polri dan juga keluarga penting bagi anak-anak agar seseorang tidak menggunakan obat terlarang tersebut. Permasalahan dalam penelitian ini, yaitu: Bagaimana peranan serta kendala yang dihadapi Kepolisian dalam penanggulangan tindak pidana penyalahgunaan narkotika serta faktor-faktor yang mempengaruhi penegakan hukum yang dilakukan oleh pelajar serta di wilayah Hukum Polres medan. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris, guna mendapat ketentuan hukum normatif dan penerapannya pada setiap peristiwa hukum tertentu. Hasil penelitian menujukkan beberapa hal: 1. Upaya kepolisian dalam menanggulangi peredaran dan penyalahgunaan narkotika di wilayah hukum Polres Medan sebagai berikut: Melakukan tindakan awal (pre-emtif) sebelum tindakan pencegahan (preventif) serta dibaca oleh masyarakat umum; 2. Kendala yang dihadapi kepolisian polres medan menjadi dua jenis yaitu hambatan internal dari pihak kepolisian itu sendiri dan hambatan eksternal salah satunya adalah faktor masyarakat.3. Faktor-Faktor yang Mempengaruhi Proses Penegakan Hukum Terdapat lima (5) faktor yang mempengaruhi proses penegakan hukum. Faktor-faktor ini meliputi, faktor hukum, faktor penegak hukum, faktor sarana prasaran, faktor masyarakat, dan faktor kebudayaan. Penegakan Hukum adalah Masalah yang Hampir Dihadapi Masyarakat. Namun peredaran narkoba masih marak di masyarakat, terutama di kalangan remaja. Berhasil tidaknya penegakan hukum bergantung pada tiga unsur yaitu, subtansi hukum, struktur hukum dan budaya hukum. The role of the National Police and also the family is important for children so that someone does not use these illegal drugs. The problems in this research are: What is the role and obstacles faced by the Police in dealing with criminal acts of narcotics abuse and the factors that influence law enforcement carried out by students and in the Medan Police Legal Area. The research method used is normative-empirical legal research, in order to obtain normative legal provisions and their application to each specific legal event. The results of the research show several things: 1. The police's efforts to tackle the distribution and abuse of narcotics in the Medan Police jurisdiction are as follows: Take pre-emptive action before preventative action and read by the general public; 2. The obstacles faced by the Medan Police are of two types, namely internal obstacles from the police themselves and external obstacles, one of which is community factors.3. Factors that Influence the Law Enforcement Process There are five (5) factors that influence the law enforcement process. These factors include legal factors, law enforcement factors, infrastructure factors, community factors, and cultural factors. Law Enforcement is a Problem Almost Faced by Society. However, drug trafficking is still widespread in society, especially among teenagers. The success or failure of law enforcement depends on three elements, namely, legal substance, legal structure and legal culture.
