Abstract: | Indonesia merupakan salah satu negara yang telah terlibat penggunaan dan pemanfaatan teknologi, permasalahan dalam penelitian ini informasi Bagaimana pengaturan hukum terkait tindak pidana Manipulasi Dokumen Elektronik di Indonesia dan, Bagaimana Kajian Hukum Terhadap Pertimbangan Hakim dalam perkara tindak pidana manipulasi Dokumen Elektronik Berdasarkan Putusan (Nomor2176/Pid.Sus/2021/PN Mdn ) . Metode penelitian digunakan adalah library research yaitu metode ini dengan melakukan penelitian terhadap berbagai sumber bacaan tertulis dari para sarjana yaitu buku,teori , jurnal hukum dan peraturan tentang tindak pidana. Field research yaitu dengan melakukan kelapangan dalam hal ini penulis langsung melakukan studi pada Pengadilan Negeri Medan dengan melakukan wawancara dengan hakim Hasil penelitian, yaitu diatur dalam Pasal 51 Ayat (1) Jo Pasal 35 UURI No.19 tahun 2016 tentang perubahan atas UURI No.11 tahun 2008 tentang Informasi dan Transaksi Elektronik pertimbangan hakim bagi pelaku tindak pidana manipulasi dokumen elektronik Terdakwa telah terbukti secara sah dan meyakinkan melanggar Keadaan yang memberatkan Perbuatan terdakwa merugikan korban dan Terdakwa sudah pernah dihukum. Keadaan yang meringankan Terdakwa berterus terang mengakui perbuatannya dan tidak mempersulit dipersidangan Terdakwa sangat menyesali perbuatannya dan Terdakwa berjanji tidak akan mengulangi perbuatannya. Indonesia is one of the countries that has been involved in the use and utilization of technology,the problem in this study was information how the legal regulation related to the criminal act of Electronic Document manipulation in Indonesia,and,how the legal study of judges’Considerations in the case of criminal manipulation of Electronic documents based on decision (Number 2176 /Pid.Sus/2021/PN Mdn). The research method used was library research,namely this method by conducting research on various writeen reading sources from scholars,namely books, theories, law journals and regulations on criminal acts .Field research,namely by conducting fieldwork in this case the author directly conducts a study at the medan district court by conducting interviews with judges. The results of the research, namely regulated in article 51 paragraph (1) Jo Article 35 UURI NO.19 OF 2016 concerning amendments to UURINo.11 of 2008 concerning Information and Electrionic Transactions,the judge’s Consideration for the perpetrator of the crime of manipulation of electronic documents.The defendant had been proven legally and convincingly violated Aggravating circumstaces,The defendant’s actions harmed the victim and the defendant had already been convicted. Mitigating circumdtances the defendant frankly admitted his actions and did not complicate the trial the defendant frankly admitted his actions and did bot complicate the trial the defendant deeply regretted his actions and the defendant promised not to repeat his actions . |
