Abstract: Penelitian ini diberi judul Perlindungan Hukum Bagi Peserta Bukan Penerima Upah Program BPJS Ketenagakerjaan Ditinjau Dari Instruksi Presiden No. 4 Tahum 2022. Rumusan masalah yaitu (1) Bagaimana aturan hukum BPJS Ketenagakerjaan menurut peraturan perundang - undangan? (2) Bagaimana bentuk prosedur – prosedur yang diberi oleh BPJS Ketenagakerjaan bagi peserta bukan penerima upah dalam mencegah kemisikinan ekstrem? (3) Bagaimana perlindungan hukum yang diberi oleh BPJS Ketenagakerjaan bagi peserta bukan penerima upah dalam mencegah kemisikinan ekstrem? Metode penelitian yakni penelitian yuridis normatif. Hasil penelitian bahwa peraturan BPJS Ketenagakerjaan diatur dalam Undang – Undang No. 40 Tahun 2004 tentang Sistem Jaminan Sosial, Undang – Undang No. 24 Tahun 2011 tentang Badan Penyelenggara Jaminan Sosial, Instruksi Presiden No. 4 Tahun 2022 Tentang Percepatan Penghapusan Kemiskinan Ekstream. Prosedur – prosedur yang diberikan oleh BPJS Ketenagakerjaan bagi peserta bukan penerima upah yakni Bagi peserta bukan penerima upah harus mengisi syarat – syarat pendaftaran bagi peserta bukan penerima upah. Perlindungan hukum yang diberi oleh BPJS Ketenagakerjaan bagi peserta bukan penerima upah yakni perlindungan hukum terhadap pekerja/ buruh yang haknya dilupakan, yaitu adanya sanksi yang tegas yang telah diatur pemerintah dalam berbagai aturan dari sanksi administratif hingga sanksi pidana.. Kesimpulan dari tesis ini yakni Prosedur – prosedur yang diberikan oleh BPJS Ketenagakerjaan bagi peserta bukan penerima upah yakni Bagi peserta bukan penerima upah harus mengisi syarat – syarat pendaftaran bagi peserta bukan penerima upah. Saran yang dapat diambil dari tesis ini yaitu Khususnya kepada Kantor BPJS Ketenagakerjaan kota Medan harus bisa meningkatkan program jaminan sosial ketenagakerjaan bagi pekerja bukan penerima upah agar masyarakat dapat mencegah kemiskinan ekstrem dan mensejahterakan keluarganya. This research is entitled Legal Protection for Non-Wage Recipient Participants of the BPJS Employment Program in View of Presidential Instruction No. 4th Year 2022. The problem formulation is (1) What are the legal regulations for BPJS Employment according to statutory regulations? (2) What are the procedures provided by BPJS Employment for non-wage recipient participants to prevent extreme poverty? (3) How does the legal protection provided by BPJS Employment for non-wage-earning participants prevent extreme poverty? The research method is normative juridical research. The research results show that harbormaster regulations are regulated in Law no. 40 of 2004 concerning the Social Security System, Law no. 24 of 2011 concerning Social Security Administering Bodies, Presidential Instruction no. 4 of 2022 concerning the Acceleration of Elimination of Extreme Poverty. The procedures provided by BPJS Employment for non-wage-receiving participants are that non-wage-receiving participants must fill in the registration requirements for non-wage-receiving participants. The legal protection provided by BPJS Employment for participants who are not wage earners, namely legal protection for workers/laborers whose rights are forgotten, namely the existence of strict sanctions that have been regulated by the government in various regulations from administrative sanctions to criminal sanctions. The conclusion of this thesis is Procedure - The procedure provided by BPJS Employment for non-wage recipient participants is that non-wage recipient participants must fill in the registration requirements for non-wage recipient participants. Suggestions that can be taken from this thesis are that, in particular, the Medan City BPJS Employment Office must be able to improve the employment social security program for non-wage earners so that the community can prevent extreme poverty and improve the welfare of their families.
