dc.description.abstract | Pesatnya pendanaan non bank, atau yang sering kita kenal dengan penggadaian kini sangat di minati masyarakat terkhususnya bagi masyarakat yang berekonomi menengah ke bawah atas dasar hal tersebut dibutuhkan perlindungan hukum serta kepastian hukum bagi para nasabah yang menggunakan jasa pendanaan non Bank salah satunya adalah PT. Budi Gadai Indonesia. Kepastian hukum merupakan hak dari setiap warga negara Indonesia, sebagaimana yang dituangkan di dalam Pasal 28D ayat (1) Undang-Undang Dasar 1945, untuk meneliti Tinjauan Yuridis Terhadap Hak-Hak Nasabah Dalam Hal Terjadinya Pelelangan Terhadap Benda Jaminan, yang dalam hal ini PT. Budi Gadai belum secara maksimal melakukan perlindungan hukum terhadap nasabahnya. Berdasarkan hal tersebut rumusan masalah dalam kajian ini yaitu bagaimana pelaksanaan hak-hak nasabah gadai oleh PT. Budi Gadai Indonesia dan bagaimana tanggung jawab hukum dalam pelaksanaan pelelangan benda jaminan pada PT. Budi Gadai Indonesia. Untuk membantu menjawab permasalahan penelitian, adapun metode penelitian skripsi ini menggunakan jenis penelitian yuridis normatif dan menggunakan pendekatan yuridis normatif, serta aturan perundang-undangan, Teknik pengumpulan data menggunakan cara penelitian kepustakaan dan wawancara, hasil penelitian ini menunjukkan bahwa PT. Budi Gadai telah melaksanakan kewajibannya sebagai salah satu perusahaan pendanaan, dengan berpedoman kepada Peraturan Otoritas Jasa Keuangan Nomor 31 /POJK.05/2016 Tentang Usaha Pergadaian dan Peraturan Otoritas Jasa Keuangan Nomor 6 Tahun 2022 Tentang Perlindungan Konsumen Dan Masyarakat di Sektor Otoritas Jasa Keuangan namun serta telah melaksanakan kewajibannya sebagai penyedia jasa sebagai mana diatur dalam Undang-Undang Nomor 08 Tahun 1999 Tentang Perlindungan Konsumen. The rapid growth of non-bank funding, or what we often know as pawning, is now very popular with the public, especially for people with middle to lower economic levels, on the basis that this requires legal protection and legal certainty for customers who use non-bank funding services, one of which is PT. Budi Gadai Indonesia. Legal certainty is the right of every Indonesian citizen, as stated in Article 28D paragraph (1) of the 1945 Constitution, to examine the Juridical Review of Customer Rights in the Event of an Auction of Collateral Objects, which in this case is PT. Budi Gadai has not provided maximum legal protection for its customers. Based on this, the formulation of the problem in this study is how to implement the rights of pawning customers by PT. Budi Gadai Indonesia and what are the legal responsibilities in carrying out the auction of collateral objects at PT. Budi Gadai Indonesia. To help answer research problems, the research method for this thesis uses a normative juridical research type and uses a normative juridical approach, as well as statutory regulations. Data collection techniques use library research and interviews. The results of this research show that PT. Budi Gadai has carried out its obligations as one of the funding companies, guided by Financial Services Authority Regulation Number 31 /POJK.05/2016 concerning Pawnshop Businesses and Financial Services Authority Regulation Number 6 of 2022 concerning Consumer and Public Protection in the Financial Services Authority Sector but also has carried out its obligations as a service provider as regulated in Law Number 08 of 1999 concerning Consumer Protection. | en_US |
