Peran Polri dalam Menanggulangi Kejahatan Geng Motor di Provinsi Sumatera Utara (Studi Kasus Tindak Pidana Penganiayaan di Wilayah Hukum Polres Deli Serdang)

Abstract

Dengan meningkatnya masalah-masalah kejahatan dan kekerasan yang berlatar belakang geng motor akhir - akhir ini, jelas akan berdampak buruk pada tatanan sosial masyarakat Deli Serdang. Aksi - aksi nyata para geng motor di Deli Serdang bukan hanya sekedar isapan jempol, korban – korban yg diakibatkan geng motor saat ini, bukan hanya penganiayan ringan tapi juga cenderung ke penganiyiaan berat bahkwan ad yang sudah meninggal. Bertolak dari hal diatas, Maka penulis mengambil tiga permasalahan dalam penelitian ini yaitu Bagaimana Pengaturan Polri Dalam Menanggulangi Kejahatan Geng Motor Di Provinsi Sumatera Utara (Studi Kasus Tindak Pidana Penganiayaan Di Wilayah Hukum Polres Deli Serdang), Bagaimana Peran Polri Dalam Menanggulangi Kejahatan Geng Motor Di Provinsi Sumatera Utara (Studi Kasus Tindak Pidana Penganiayaan Di Wilayah Hukum Polres Deli Serdang), Bagaimana Faktor Penghambat Polri Dalam Menanggulangi Kejahatan Geng Motor Di Provinsi Sumatera Utara (Studi Kasus Tindak Pidana Penganiayaan Di Wilayah Hukum Polres Deli Serdang). Berdasarkan permasalahan diatas maka penulis dapat menjawab atas permaslahan tersebut yakni bahwa pengaturan internal polri khususnya personil polresta Deli Serdang dalam menanggulangi kejahatan khususnya tindak pidana penganiyaan yang dilakukan oleh geng motor di Wilayah hukum Polresta Deli Serdang sudah cukup ada dalam menjalankan fungsi Preemtif, Preventif maupun Represif. Adapun implemantasi polri khususnya personil polresta Deli Serdang dalam menanggulangi kejahatan tindak pidana penganiyaan yang dilakukan oleh pelaku geng motor sudah berjalan dengan baik salah satunya membentuk satgas kerja gabungan internal baik dari satuan binmas, reskrim, lalu lintas dll, khusus dalam menangani kajahatan Geng Motor di Wilayah hukum Polresta Deli Serdang. Akan tetapi implementasi diatas terasa kurang maksimal khususnya keterlibatan lintas sektoral terkait seperi Dinas social, dinas Pendidikan dan OPD terkaiit. Adapun beberapa hambatan seperti keterbatasan anggaran, prasaran seperti motor trail dll, Kurangnya dukungan sekaligus perlibatan lintas sectoral seperti beberapa OPD dinas terkait, Masyarakat, Para tokoh agama, Para Toko Adat dalam mengkolaborasi program - program Presisi Kapolri. Penelitian ini dilaksanakan dengan menggunakan metode deskriptif analitis dengan pendekatan yuridis normatif dan yuridis empiris. Pendekatan yuridis normatif digunakan untuk mengetahui sejauh mana asas-asas hukum, sinkronisasi vertikal/ horisontal, dan sistemik hukum diterapkan. Sedangkan, pendekatan yuridis empiris pada prinsipnya hukum dikonsepsikan secara sosiologis sebagai gejala empiris yang dapat diamati dalam kehidupan secara empiris yang teramati dalam pengalaman. Adapun upaya antisipatif di masa yang akan datang dapat dilakukan dengan antisipasi polres Deli Serdang, yaitu mempersiapkan peraturan atau surat telegram khusus terkait persiapan dan kesiapan para personil satker. Sedangkan upaya kolaborasi dapat ditempuh dengan melakukan pendekatan berbasis lintas sektoral khususnya pendalaman agama, budaya/kultural, moral/edukatif guna mendukung upaya premtif, preventif dan represif dengan sasaran fokus kepada penguatan agama, penanaman nilai budi pekerti yang luhur, etika sosial, serta efek jera pada pelaku berbasis prediktif, resposibilitas, transparan dan berkeadilan. With the increasing problems of crime and violence caused by motorcycle gangs recently, this will clearly have a negative impact on the social order of the Deli Serdang community. The real actions of the motorbike gangs in Deli Serdang are not just a figment of imagination, the victims caused by motorbike gangs today are not only light abuse but also tend to be serious abuse, even those who are already dead. Based on the above, the author took three problems in this research, namely: How is the National Police Arrangement in Overcoming Motorcycle Gang Crime in North Sumatra Province (Case Study of the Crime of Persecution in the Deli Serdang Police's Legal Area), What is the Role of the National Police in Overcoming Motorcycle Gang Crime in the Province North Sumatra (Case Study of the Criminal Act of Persecution in the Legal Area of the Deli Serdang Police), What are the Inhibiting Factors for the National Police in Overcoming Motorbike Gang Crime in North Sumatra Province (Case Study of the Criminal Act of Persecution in the Legal Area of the Deli Serdang Police). Based on the problems above, the author can answer this problem, namely that the internal arrangements of the National Police, especially Deli Serdang Police personnel in dealing with crimes, especially criminal acts of abuse committed by motorbike gangs in the jurisdiction of the Deli Serdang Police, are sufficient in carrying out Preemptive, Preventive and Repressive functions. This research was carried out using analytical descriptive methods with a normative juridical and empirical juridical approach. Meanwhile, the empirical juridical approach, in principle, law is conceptualized sociologically as an empirical phenomenon that can be observed in life empirically observed in experience. Anticipatory efforts in the future can be carried out by anticipating the Deli Serdang police, namely preparing special regulations or telegrams regarding the preparation and readiness of the work unit personnel. Meanwhile, collaborative efforts can be taken by carrying out a cross-sectoral based approach, especially deepening religion, culture, morals/education to support preemptive, preventive and repressive efforts with the target of focusing on strengthening religion, instilling noble moral values, social ethics, and a deterrent effect. on actors based on predictive, responsive, transparent and fair.
