dc.description.abstract | Dalam dunia kerja seringkali posisi pekerja/pegawai sering tidak seimbang, biasanya lebih mendominasi dari pihak perusahaan sebagai posisi terkuat dan perjanjian disesuaikan kebutuhan perusahaan sementara pihak pekerja berada diposisi lemah dan dituntut untuk beradaptasi dengan situasi seperti yang diinginkan perusahaan. Seperti yang telah disebutkan sebelumnya, karena tingginya pergantian pekerja pada berbagai masalah, sangat penting bahwa perjanjian PCB terus menjadi informasi untuk negosiasi pekerja di PT. Telkom.Tbk. Rumusan masalah yang diambil adalah: bagaimana pengaturan tentang perjanjian bagi karyawan PT di Indonesia, bagaimana prosedur penyusunan perjanjian dari hubungan antara perusahaan Perseroan Terbatas dengan karyawan dalam perspektif hukum serta bagaimana implementasi perjanjian kerja karyawan PT Telekomunikasi Indonesia Regionsl 1 Kota Medan menurut hukum ketenagakerjaan. Jenis penelitian yang akan digunakan dalam peneitian ini adalah Penelitian Hukum Yuridis Normatif. Hasil penelitian Pengaturan perjanjian kerja perseroan terbatas di Indonesia dalam hal suatu perjanjian kerja dapat disahkan oleh kedua belah pihak karena alasan kepastian hukum, perlindungan dan keadilan, diperlukan partisipasi atau campur tangan pemerintah. Implementasi perjanjian kerja karyawan dengan PT Telekomunikasi Indonesia (TELKOM) Regional 1 Medan telah mengacu pada peraturan perundang-undangan, Undang-Undang Nomor 13 Tahun 2003 Pasal 116 ayat 2 yang mengatur berkaitan dengan peran yang dilakukan oleh Serikat Karyawan. PT. Telkom.Tbk dalam proses pembuatan PKB mengikutsertakan peran Serikat Karyawan PT. Telkom.Tbk bertujuan Serikat pekerja terpanggil untuk melindungi kesejahteraan, hak dan kepentingan pekerja dan keluarganya, serta meningkatkan kesejahteraan. In the world of work, the position of workers/employees is often unequal, usually more dominant than the company as the strongest position and the agreement is adjusted to the needs of the company while the workers are in a weak position and are required to adapt to the situation as the company wants. Given the dynamic development of the workforce with various problems that can arise as mentioned above, it should be that the implementation of the agreed PKB must remain a reference for work relations at PT. Telkom.Tbk. The formulation of the problem taken is: how to regulate agreements for PT employees in Indonesia, what are the procedures for drafting agreements from the relationship between Limited Liability Company companies and employees from a legal perspective and how to implement work agreements for employees of PT Telekomunikasi Indonesia Regionsl 1 Medan City according to labor law. The type of research that will be used in this research is Normative Juridical Law Research. The results of the research regarding the regulation of limited liability company work agreements in Indonesia where the existence of work agreements can be well received by all parties, because there is legal certainty, protection and justice, for this reason the role or intervention of the government is needed. The implementation of the employee work agreement with PT Telekomunikasi Indonesia (TELKOM) Regional 1 Medan has referred to statutory regulations, Law Number 13 of 2003 Article 116 paragraph 2 which regulates the role played by the Employees Union. PT. Telkom.Tbk in the process of making the PKB includes the role of the Employees Union of PT. Telkom.Tbk aims to form an Employee Union is to provide protection, defend rights and interests and improve proper welfare for employees and their families. | en_US |
