dc.description.abstract | Penelitian ini mengkaji tentang bagaimana sesungguhnya jaminan dan perlindungan masyarakat yang melakukan jual beli hanya dengan cara dibawah tangan atau bagaimana keabsahan dan kekuatan terhadap pemindahan hak atas tanah dengancara jual beli yang dilakukan dibawah tangan Untuk membahas latar belakang maka diajukan permasalahan yaitu Bagaimana tentang perjanjian jual beli atas tanah menurut hukum Perdata. Untuk membahas permasalahan tersebut maka dilakukan penelitian secara kepustakaan dan penelitian lapangan pada Desa Bintang Meriah Kecamatan Batang Kuis Kabupaten Deli Serdang. Dengan cara menganalisis bagaimana Tinjauan Tentang Perjanjian Jual Beli Hak Atas Tanah Menurut Hukum Perdata di Desa terse but. Hasil penelitian menyimpulkan masyarakat masih belum merasakan bahwa institusi pertanahan sebagai publik servce belum bekerja secara maksimal dalam melakukan sosialisasi betapa pentingnya pendaftaran hak atas tanah. Jual beli yang dilakukan berdasarkan perjanjian dibawah tngan, sebelum maupun sesudah nya berlakunya UUPA No 5 Tahun 1960 kepemilikan hak atas tanah tetep diakui keabsahannya.P endaftaran hak atas tanah semata-mata menjain perlindungan kepastian hukum serta terciptanya tertib administrasi pertanahan, namun pada kenyataan masih belum berjalan sesuai dengan maksud dibuatnya pengaturan ini walaupun ada program sertifikasi dari pemerintah.
