dc.description.abstract | Berdasarkan Pennanaker No 6 Tahun 2016 THR diberikan kepada Pekerja pada 7 Hari sebelum hari raya keagamaan. Namun pada putusan in.i tidak sesuai dengan Permanaker tersebut.Permasalahan yang di teliti adalah bagaimana aturan hukum terhadap pekerja dengan PKWT, Bagaimana tanggung jawab hukum terhadap pekerja waktu tertentu atas hak tunjangan hari raya, Bagaimana pertimbangan hukum hakim dalam Putusan No.224/Pdt.Sus-Plll/2022/PN.Mdn terhadap pekerja waktu tertentu dalam pembayaran tunjangan hari raya. Penelitian ini bersifat yuridis normatif, Teknik pengumpulan data yang digunakan untuk menjawab permasalahan dalam penelitian ini, melalui: Studi kepustakaan, studi lapangan dan wawancara. Kesirnpulan Peraturan Pemerintah Republik Indonesia Nomor 35 tahun 2021 Tentang Perjanjian Kerja Waktu Tertentu Alih Daya, Waktu Kerja dan Waktu Istirahat, Dan Pemutusan Hubungan Kerja. Sesuai dalam pasal 8 PP 35 Tahun 2021 batas masksimal masa kerja pekerja PKWT yaitu 5 tahun, Pengusaha yang terlambat membayar THR Keagamaan kepada Pekerja/Buruh dikenai denda sebesar 5% dari total THR Keagamaan yang harus dibayar, dalam Putusan Nomor 224/pdt.Sus-PHI/2022/PN.Mdn dalam putusan Hakim menerima sebagian gugatan penggugat, Hakim menyatakan sejak tahun 2018 penggugat di nyatakan sebagai pekerja tetap (PKWTT). Saran perusahaan harus lebih memahami dan melaksanakan ketentuan undang-undang tenaga kerja khususnya dalam pemberian upah dan kewajiban buruh. perusahaan harus lebih bertanggung jawab atas kewajiban dan tanggung jawabnya mengenai upah dan kewajiban yang harus di berikan kepada pekerja. Hakim harus memberikan putusan tidak hanya dengan melihat fakta-fakta di persidangan. Based on Permanaker (Regulation of the Minister of Manpower) No. 6 of 2016, THR (Religious Holiday Allowance) is given to workers seven days before religious holidays. However, this discussed decision does not follow the Permanaker. The problems studied were: what legal rules for workers with PKWT (Certain Time Work Agreement), what legal responsibility for certain time workers regarding the right to holiday allowance, and what judge's legal consideration in Decision No.224/Pdt.Sus PHI/2022/PN.Mdn for certain time workers in the payment of holiday allowance. This research was normative juridical. The data collection techniques used to answer the problems in this research, were through literature study, field study, and interviews. The conclusion was the Government Regulation of the Republic of Indonesia No. 35 of 202 J on Certain Time Outsourcing Work Agreements, Working Hours and Rest Period, and Termination of Employment Relations. Based on Article 8 of Government Regulation No. 35 of 2021, the maximum working period for PKWT (Certain Time Work Agreement) workers is 5 years, employers who are late in paying Religious Holiday Allowance to Workers/Laborers will be fined of 5% of the total amount to be paid, in the Decision Number 224/Pdt.Sus- PHI/2022/PN.Mdn, in the judge's decision accepting part of the plaintiffs claim, the judge stated that the plaintiff had been declared as a permanent worker (PKWTT) since 2018. The suggestion was that the company must better understand and implement the provisions of the Labor Code, especially in providing wages and labor obligations. Companies must be more responsible for their obligations and responsibilities regarding wages and obligations that must be given to workers. The judge must make a decision not only by looking at the facts at the trial. | en_US |
