dc.description.abstract | Secara umum jual beli yang dilakuk:an secara secara tertulis oleh para pihak bertujuan untuk dijadikan sebagai alat bukti, baik ada sengketa maupun tidak, jual beli dilakuk:an secara tertulis ada yang dilakukan dibawah tangan, akan tetapi ada pula yang dilakukan secara notariil, tergantung dari seberapa jauh nilai dan kepentingan jual beli tersebut bagi para pelakunya. Permasalahan dari penelitian ini bagaimana penerapan pasal-pasal Kitab Undang-Undang Hukum Perdata pada jual beli bangunan rumah dalam akta Notaris dan Apakah seorang Notaris menemukan kendala yang dihadapi dalam menerapkan pasal-pasal Kitab.. Undang-Undang Hukum Perdata pada aktajual beli bangunan rumah. Dalam kitab Undang undang Hukum Perdata (KUHPerdata) Pasal 1338(1) dinyatakan bahwa semua perjanjian yang dibuat secara sah berlaku sebagai undang undang bagi mereka yang membuatnya. Artinya, apabila objek hukum yang dilakuk:an tidak berdasarkan niat yang tulus, maka secara otomatis hukum perjanjian tersebut dibatalkan demi hukum. Sehingga masing masing pihak tidak mempunyai dasar penuntutan di hadapan hakim. This means, if the legal object if something is done that is not based on sincere intentions, it is automatically legal the agreement is canceled by law.
