Abstract: Tindak pidana desersi merupakan tindak pidana yang secara khusus dilakukan oleh seorang anggota militer. Tindak pidana desersi merupakan lanjutan dari tindak pidana yang diatur dalam Pasal 86 KUHPM. Tidak Hadir Tanpa Ijin (selanjutnya disingkat THTI) yang mana perbuatan tersebut melanggar dan bertentangan dengan Undang-Undang Hukum Militer. Permasalahan yang dibahas dalam penelitian ini adalah bagaimana aturan hukum terhadap militer yang melakukan desersi secara (inabsensia) dan bagaimana penyelesaian hukum terhadap militer yang melakukan kejahatan desersi secara (inabsensia). Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum Yuridis Normatif, guna menjawab isu hukum yang dihadapi. Dalam penyelesaian secara Inabsensia tindak pidana desersi yang dilakukan oleh prajurit TNI di Pengadilan Militer I-02 Medan sudah diatur secara tegas yang tertuang dalam UndangUndang Nomor 31 Tahun 1997 pada Pasal 124 ayat (4), Pasal 141 ayat (10), Pasal 143. Pemeriksaan perkara desersi secara inabsensia dalam persidangan, Oditur Militer harus terlebih dahulu melakukan pemanggilan terhadap terdakwa 3 (tiga) kali berturut-turut secara sah untuk hadir di dalam persidangan. Ketika tidak hadir terdakwa akan dilanjutkan pembacaan surat dakwaan, pemeriksaan saksi, dan barang bukti. Proses pemeriksaan dan persidangan yang dilakukan secara Inabsensia serta putusan hukuman yang ditetapkan pada Putusan Nomor 34- K/PM.I-02/AD/IV/2023 sudah sesuai dengan peraturan Perundang-undangan yang berlaku dan kaidah atau unsur-unsur penjatuhan sanksi yang harus dipertimbangkan oleh Majelis Hakim. The crime of desertion is a criminal offense specifically committed by a member of the military. The crime of desertion is a continuation of the criminal offense regulated in Article 86 of the Criminal Code. Absence Without Permission (hereinafter abbreviated as THTI) which violates and contradicts the Law on Military Law. The problems discussed in this study were how the legal rules applied to the military who committed desertion (in absentia) and how the legal settlement of the military who committed the crime of desertion (in absentia) was handled. The method used in this research was the Normative Juridical legal research method, in order to address the legal issues at hand. The in absentia settlement of desertion crimes committed by TNI soldiers in Military Court I-02 Medan was expressly regulated in Law Number 31 of 1997, in Article 124 paragraph (4), Article 141 paragraph (10), and Article 143. In the examination of desertion cases in absentia during the trial, the Military Oditur had to first summon the defendant three consecutive times legally to attend the trial. When the defendant was not present, the reading of the indictment, examination of witnesses, and presentation of evidence would continue. The examination process and trial conducted in absentia, as well as the sentence determined in Decision Number 34-K/PM.I-02/AD/IV/2023, were in accordance with the applicable laws and regulations and the rules or elements of imposing sanctions that had to be considered by the Panel of Judges.
