Penerapan Restorative Justice dalam Penyelesaian Kasus Kecelakaan Berat Laka Lantas (Studi Kasus Satlantas Polrestabes Medan)

Abstract

Angka kecelakaan lalu lintas yang meningkat dan menimbulkan korban luka berat serta kerugian material besar menuntut pendekatan penyelesaian yang tidak hanya memberikan efek jera kepada pelaku, namun juga memulihkan keadaan serta memperbaiki hubungan antar pihak. Penelitian ini bertujuan mengkaji penerapan restorative justice dalam penyelesaian kasus kecelakaan berat laka lantas di Satlantas Polrestabes Medan, mengidentifikasi kendalanya, serta memberikan gambaran komprehensif implementasi konsep tersebut dalam konteks penanganan kasus kecelakaan lalu lintas berat. Penelitian yuridis normatif ini menggunakan datasekunder. Analisis data dalam penelitian ini menggunakan analisis kualitatif deskriptif dengan model interaktif. Hasil penelitian Peraturan Kapolri Nomor 8Tahun 2021 mengatur penanganan tindak pidana berdasarkan keadilan restoratif. Ini melibatkan prosedur yang meliputi identifikasi kasus, perolehan persetujuandari korban/keluarga, musyawarah untuk mencapai kesepakatan, pelaksanaankewajiban pelaku, penyelesaian kasus atau lanjutan ke proses peradilan pidana jikaterjadi kegagalan. Peraturan ini juga menegaskan peran dan tanggung jawabmasing-masing pihak yang terlibat serta mekanisme pelaksanaan restorative justicemelalui musyawarah yang melibatkan semua pihak terkait untuk mencapai kesepakatan yang adil dan memulihkan keadaan. Kesimpulannya SatlantasPolrestabes Medan menerapkan restorative justice melalui proses pendekatan, mediasi, pertemuan, dan negosiasi untuk mencapai kesepakatan penyelesaian yangadil dan memulihkan keadaan. The increasing number of traffic accidents and causing serious injuries and largematerial losses requires a settlement approach that not only provides a deterrent effect to the perpetrators, but also restores the situation and improves relationsbetween parties. This study aims to examine the application of restorative justice inresolving cases of serious accidents at the Medan Police Station, identify theobstacles, and provide a comprehensive overview of the implementation of theconcept in the context of handling heavy traffic accident cases. This normativejuridical research uses secondary data. The data analysis in this study usesQualitatif descriptive analysis with an interactive model. The results of the researchof the National Police Chief's Regulation Number 8 of 2021 regulate the handlingof crimes based on restorative justice. This involves procedures that include caseidentification, obtaining consent from the victim/family, deliberations to reach anagreement, implementation of the perpetrator's obligations, case settlement orcontinuation to the criminal justice process in the event of failure. This regulationalso affirms the roles and responsibilities of each party involved as well as themechanism for implementing restorative justice through deliberation involving all relevant parties to reach a fair agreement and restore the situation. In conclusion, the Medan Police Station implements restorative justice through the process of approach, mediation, meetings, and negotiations to reach a fair settlement agreement and restore the situation.
