Tinjauan Yuridis Wanprestasi dalam Perjanjian Pinjam-Meminjam Emas (Studi Putusan Nomor 52/Pdt./2023/Pn.Mdn)

Abstract

Tujuan penelitian adalah untuk mengetahui pertimbangan hakim dalam memutus perkara nomor 52/Pdt-G./2023/PN.Mdn, untuk mengetahui akibat hukum terhadap wanprestasi dalam pinjam emas studi putusan nomor 52/Pdt./2023/Pn.Mdn. metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif atau penelitian hukum doktrinal. Dari hasil penelitian yang dilakukan penulis berkesimpulan bahwa pertimbangna hakim dalam memutus perkara putusan nomor 52/Pdt-G/2023/PN.Mdn, dengan serangkaian fakta hukum dari bukti surat secara normatif dapat dipandang sempurna karena tidak ada bantahan dari pihak Para Tergugat maka sangat jelas Para Tergugat tersebut tidak pernah memenuhi prestasi yang telah diperjanjikan baik secara menyeluruh maupun sebahagian, oleh karenya dalam keadaan yang demikian secara yuridis normatif para tergugat tersebut telah cukup terbukti melakukan perbuatan ingkar janji (wanprestasi) terhadap Penggugat semula (vide Pasal 1238 KUHPerdata) akibat hukum terhadap wanprestasi dalam pinjam emas studi putusan nomor 52/Pdt./2023/Pn.Mdn Menghukum para tergugat untuk melunasi hutang-piutangnya sesuai dengan Surat Pengakuan Hutang Dengan Jaminan Sertifikat, Sebidang tanah berikut bangunan dengan Sertifikat Hak Guna Bangunan dengan nomor 186, luas 1567 M2 (seribu lima ratus enam puluh tujuh meter persegi), tertulis dalam Sertifikat atas nama Sunarjo Soeng berikut segala sesuatu yang telah ada dan/atau aka nada dan tertanam di atas tanah tersebut. The aim of the research is to find out the judge's considerations in deciding case number 52/Pdt-G./2023/PN.Mdn, to find out the legal consequences of default in gold loans, study decision number 52/Pdt./2023/Pn.Mdn. The research method used in this writing is normative juridical or doctrinal legal research. From the results of research conducted by the author, it is concluded that the judge's consideration in deciding case decision number 52/Pdt-G/2023/PN.Mdn, with a series of legal facts from documentary evidence can be considered normatively perfect because there is no objection from the defendants, so it is very clear. The Defendants have never fulfilled the achievements that had been agreed to, either in whole or in part, therefore in such circumstances, legally normatively, the Defendants have been sufficiently proven to have committed an act of breach of promise (default) against the original Plaintiff (vide Article 1238 of the Civil Code) with legal consequences for default in gold loan study decision number 52/Pdt./2023/Pn.Mdn Sentenced the defendants to pay off their debts in accordance with the Debt Acknowledgment Letter with Certificate Guarantee, a plot of land and building with Building Use Rights Certificate number 186, area 1567 M2 (one thousand five hundred and sixty seven square meters), written in the Certificate in the name of Sunarjo Soeng along with everything that already exists and/or will exist and be embedded on said land.
