dc.description.abstract | Pengadaan tanah bagi pembangunan untuk kepentingan umum merupakan suatu kegiatan yang akan terus dilakukan terlebih dengan ditambahnya ketentuan kepentingan umum yang dimuat didalam Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan PERPPU Cipta Kerja Menjadi UU. Namun penyelenggaraan pengadaan tanah sering menimbulkan konflik karena nilai yang diberikan kepada pemegang hak tidak sesuai dengan keinginan masyarakat. Metode yang digunakan dalam penelitian ini adalah metode normatif untuk mencari dasar hukum yang mengatur ketentuan perlindungan hukum serta mekanisme penetapan nilai ganti kerugian dalam penyelenggaraan pengadaan tanah dengan melakukan studi di Kantor Pertanahan Kota Medan. Pihak yang terdampak pengadaan tanah berhak mendapatkan ganti kerugian yang adil dan layak atas kegiatan pengadaan tanah. Perlindungan hukum bagi pemegang hak atas tanah menjadi hal yang sangat diperhatikan sehingga masyarakat mendapatkan jaminan serta kepastian hukum sebagai bentuk tanggungjawab negara terhadap warga negara. Tanggungjawab pemerintah dalam hal ini adalah dengan memberikan ganti kerugian yang adil dan layak kepada pihak yang terdampak. Penilaian ganti kerugian dilakukan oleh Tim Penilai atau Penilai Publik dengan memperhatikan standar penilaian yang berlaku. Menemukan perlindungan hukum terhadap pemegang hak atas tanah serta bagaimana mekanisme penetetapan ganti kerugian dalam pengadaan tanah adalah tujuan dari penelitian ini. The acquisition of land for development in the public interest is an activity that will continue to be carried out, especially with the addition of public interest provisions as stipulated in Law No. 6 of 2023 concerning the Stipulation of the Job Creation PERPPU into Law. However, the implementation of land acquisition often leads to conflicts because the value offered to the rights holders does not meet the public’s expectations. The method used in this research was the normative method to find the legal basis governing the provisions of legal protection as well as the mechanism for determining compensation values in the implementation of land acquisition by conducting a study at the Land Office of Medan City. Parties affected by land acquisition were entitled to fair and proper compensation for land acquisition activities. Legal protection for land rights holders is a key concern to ensure that the public receives guarantees and legal certainty as a form of the state's responsibility to its citizens. The government’s responsibility in this case was to provide fair and proper compensation to the affected parties. The compensation assessment was carried out by an Appraisal Team or Public Appraisers, taking into account the applicable valuation standards. Finding legal protection for land rights holders and determining the compensation mechanism in land acquisition was the aim of this research. | en_US |
