Abstract: | Tujuan penelitian ini adalah untuk mengetahui Pengaturan Hukumh Tentang Eksploitasi Anak Berdasarkan Hukum Positif Anak untuk mengetahui perlindungan hukum terhadap anak sebagai kobran tindak pidana eksploitasi seksual. Metode penelitian yang digunakan adalah penelitian normatif, teknik pengumpulan data yaitu dengan melakukan penelitian kepustakaan dan wawancara. Dari hasil penelitian yang peneliti lakukan di tarik kesimpulan bahwa Pengaturan Hukumh Tentang Eksploitasi Anak Berdasarkan Hukum Positif Anak Undang-Undang Nomor 17 Tahun 2016 tentang Penetapan Peraturan Pemerintahan Pengganti Undang-undang Nomor 1 tahun 2016 tentang perubahan kedua atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, Undang-Undang Nomor 21 Tahun 2007 Tentang Tindak Pidana Perdagangan Orang, Pasal 296 KUHP dan Pasal 506 KUHP, Perlindungan Hukum Terhadap Anak Sebagai Kobran Tindak Pidana Eksploitasi Seksual Pasal 59 ayat (1) Undang-Undang No. 35 tahun 2014 tentang perlindungan Anak menyatakan “Pemerintah, Pemerintah Daerah dan Lembaga Negara lainnya berkewajiban dan bertanggungjawab untuk memberikan Perlindungan Khusus kepada Anak The purpose of this research is to determine the legal regulations regarding child exploitation based on Child Positive Law to determine the legal protection for children as victims of sexual exploitation crimes. The research method used is normative research, data collection techniques are by conducting library research and interviews. From the results of the research conducted by researchers, it was concluded that legal regulations regarding child exploitation are based on the Child Positive Law, Law Number 17 of 2016 concerning the Stipulation of Government Regulations in Lieu of Law Number 1 of 2016 concerning the second amendment to Law Number 23 of 2002 concerning Child Protection, Law Number 21 of 2007 concerning the Crime of Human Trafficking, Article 296 of the Criminal Code and Article 506 of the Criminal Code, Legal Protection of Children as Victims of the Crime of Sexual Exploitation Article 59 paragraph (1) of Law no. 35 of 2014 concerning Child Protection states "The Government, Regional Government and other State Institutions are obliged and responsible to provide Special Protection to Children |
