dc.description.abstractNotaris mempunyai tanggung jawab menyimpan minuta akta dengan baik supaya terhindar dari kerusakan dan kehilangan. Adapun tujuan penelitian ini yaitu mengetahui pengaturan hukum terhadap tanggung jawab Notaris dalam penyimpanan minuta akta rusak atau hilang dan mengetahui tanggung jawab notaris terhadap penyimpanan minuta akta rusak atau hilang. Metode penelitian yang digunakan yuridis normatif dengan instrumen pengumpulan data observasi, wawancara, dan studi dokumentasi dengan analisis data deskriptif kualitatif. Hasil kajian ini menunjukkan bahwa pengaturan hukum tanggung jawab Notaris terhadap penyimpanan minuta akta cukup jelas diatur dalam Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, Undang-Undang Nomor 43 Tahun 2009 Tentang Kearsipan, Undang-Undang Nomor 1 Tahun 2024 Tentang Informasi dan Transaksi Elektronik. Adapun tanggung jawab Notaris apabila minuta akta rusak atau hilang akibat bencana alam maka Notaris bertanggung jawab melapor kepolisian, membuat berita acara lalu melapor ke Majelis Pengawas Daerah terkait rusak atau hilangnya minuta akta apabila para pihak menginginkannya maka dapat diajukan penetapan pengadilan sedangkan apabila minuta akta rusak atau hilang akibat kelalaian maka Notaris bertanggung jawab dengan dikenai sanksi administratif dan sanksi perdata. The notary has the responsibility to keep the minutes of the deed properly so that avoid damage and loss. The aims of this research are: know the legal regulations regarding the Notary's responsibilities storage of damaged or lost deed minutes and knowing responsibility notary regarding the storage of damaged or lost deed minutes. Research methods used by normative juridical with observational data collection instruments, interviews, and documentation studies with qualitative descriptive data analysis. Results This study shows that the legal regulation of Notary responsibilities regarding the storage of deed minutes is quite clearly regulated in the Law Number 2 of 2014 concerning Notary Positions, Law Number 43 of 2014 2009 concerning Archives, Law Number 1 of 2024 concerning Information and Electronic Transactions. The responsibility of the Notary if: If the minutes of the deed are damaged or lost due to natural disasters, the Notary is responsible responsible for reporting to the police, making minutes and then reporting to the Assembly The relevant Regional Supervisor damages or loses the minutes of the deed if the parties If you want it, you can submit a court order, whereas if If the minutes of the deed are damaged or lost due to negligence, the Notary is responsible subject to administrative sanctions and civil sanctions.en_US
