Abstract: Pengusaha dalam melakukan PHK harus berdasarkan alasan-alasan yang terdapat dalam undang-undang dan tidak dilakukan secara sepihak. Penelitian ini bertujuan untuk mengkaji mengenai prosedur PHK menurut Undang-Undang Ketenagakerjaan dan Undang-Undang Cipta Kerja, perlindungan hukum terhadap tenaga kerja yang mengalami PHK secara lisan melalui media elektronik dan pertimbangan hukum hakim terkait PHK terhadap tenaga kerja dalam putusan Nomor 135/Pdt.Sus-PHI/2023/PN Mdn. Jenis penelitian ini adalah yuridis normatif yang bersifat deskriptif analisis. Metode pengumpulan data melalui wawancara dan studi kepustakaan. Berdasarkan hasil penelitian, prosedur PHK menurut Undang- Undang Ketenagakerjaan yaitu wajib dirundingkan oleh pengusaha dengan pekerjanya langsung. Jika perundingan tidak menghasilkan kata sepakat, pengusaha hanya dapat melakukan PHK setelah memperoleh penetapan lembaga penyelesaian perselisihan hubungan industrial atau pengadilan, sedangkan prosedur PHK dalam Undang-Undang Cipta Kerja bahwa PHK tidak harus melalui penetapan Pengadilan Hubungan Industrial. Perlindungan hukum terhadap tenaga kerja yang mengalami PHK secara lisan melalui media elektronik terdapat pada Pasal 156 Undang- Undang Cipta Kerja. Pertimbangan hukum hakim terkait PHK terhadap tenaga kerja secara lisan melalui media elektronik dalam putusan Nomor 135/Pdt.Sus- PHI/2023/PN Mdn didasarkan pada kaidah-kaidah hukum yang ada, alat bukti maupun keterangan saksi untuk mendapatkan fakta hukum dalam persidangan, sehingga akhirnya majelis hakim menyatakan bahwa PHK tersebut tidak sah karena bertentangan dengan peraturan perundang-undangan. Employers in carrying out layoffs must be based on the reasons contained in the law and not carried out unilaterally. This research aims to examine layoff procedures according to the Employment Law and Job Creation Law, legal protection for workers who experience layoffs verbally via electronic media and the judge's legal considerations regarding layoffs of workers in decision Number 135/Pdt.Sus-PHI/2023 /PN Mdn. This type of research is normative juridical which is descriptive analysis. Data collection methods through interviews and literature study. Based on the research results, layoff procedures according to the Employment Law must be negotiated by employers with their workers directly. If negotiations do not result in an agreement, employers can only carry out layoffs after obtaining a determination from an industrial relations dispute resolution institution or court, whereas the layoff procedure in the Job Creation Law states that layoffs do not have to go through a determination by the Industrial Relations Court. Legal protection for workers who experience layoffs verbally via electronic media is contained in Article 156 of the Job Creation Law. The judge's legal considerations regarding layoffs of workers verbally via electronic media in decision Number 135/Pdt.Sus-PHI/2023/PN Mdn are based on existing legal rules, evidence and witness statements to obtain legal facts in the trial, so that Finally, the panel of judges stated that the layoffs were invalid because they were contrary to statutory regulations.
