dc.description.abstractPenelitian tesis ini berjudul Peran Advokat Terhadap Penegakan Huku Ketenagakerjaan (Studi Dinas Ketenagakerjaan Kota Medan). Rumusan masalahnya yakni (1) Bagaimana pengaturan hukum terhadap Advokat menurut peraturan perundang-undangan? (2) Bagaimana peran Advokat dalam menegakkan hukum ketenagakerjaan di Dinas Ketenagakerjaan Kota Medan? (3) Apa kendala yang dihadapi Advokat dalam menegakkan hukum ketenagakerjaan di Dinas Ketenagakerjaan Kota Medan? Metode penelitian yang dipakai yakni yuridis normatif. Hasil penelitian menunjukkan bahwa peran advokat dalam penegakan hukum ketenagakerjaan terdiri atas (1)Aturann hukum Advokat yakni: UU No. 18 Tahun 2003 Tentang Advokat, UU No.16 Tahun 2011 Tentang Bantuan Hukum, Surat Ketua Mahkamah Agung No. 73/KMA/HK.01/IX/2015 tentang Penyumpahan Advokat. (2) Advokat berperan dalam mendampingi kliennya serta mengurus hak-hak kepentingan kliennya selama proses mediasi di Dinas Ketenagakerjaan, Advokat berperan dalam mengikuti persidangan di Pengadilan Hubungan Industrial dari awal persidangan sampai keluarnya Keputusan Hakim Pengadilan Hubungan Industrial. berbagai peran Advokat tersebut dapat memberi pengertian bahwa Advokat merupakan seoarng ahli hukum yang memberikan jasa maupun bantuan hukum kepada kliennya. Bantuan hukum itu dapat berupa nasihat hukum, pembelaan, serta pendampingan kliennya dalam beracara serta penyelesaian perkara didalam pengadilan.(3) Kendala yang dihadapi Advokat yakni ditinjau dari sarana & prasarana yaitu minimnya dana honorarium yang dibutuhkan advokat dalam melengkapi sarana dan prasarana yang dibutuhkan sehingga menjadi kendala advokat dalam melakukan penegakan hukum ketenagakerjaan. Kesimpulan dari tesis ini yakni kendala yang dihadapi oleh Advokat yakni sulitnya menghadirkan para pihak yang berselisih yang mana dapat dilihat dari aspek pengusaha, yang pekerja berharap unsur pengusaha agar segera datang untuk bermediasi di Instansi Ketenagakerjaan, akan tetapi unsur pengusaha tidak menghadiri proses mediasi tersebut. Saran dari tesis ini yakni kepada Advokat harus menjunjung tinggi nilai integritas dan tetap berpegang teguh pada kode etik profesi Advokat. This thesis research is entitled The Role of Advocates in Enforcing Employment Law (Study of Medan City Manpower Office). The formulation of the problem is (1) How is the legal regulation of Advocates according to statutory regulations? (2) What is the role of Advocates in enforcing employment law at the Medan City Manpower Office? (3) What are the obstacles faced by Advocates in enforcing employment law at the Medan City Manpower Office? The research method used is normative juridical. The results of the study indicate that the role of advocates in enforcing employment law consists of (1) Advocate legal regulations, namely: Law No. 18 of 2003 concerning Advocates, Law No. 16 of 2011 concerning Legal Aid, Letter of the Chief Justice of the Supreme Court No. 73/KMA/HK.01/IX/2015 concerning Advocate Oath. (2) Advocates play a role in accompanying their clients and taking care of their clients' rights and interests during the mediation process at the Manpower Office. Advocates play a role in attending trials at the Industrial Relations Court from the beginning of the trial until the Industrial Relations Court Judge's Decision is issued. The various roles of Advocates can provide an understanding that Advocates are legal experts who provide services or legal assistance to their clients. This legal assistance can be in the form of legal advice, defense, and assistance to their clients in litigation and settlement of cases in court. (3) The obstacles faced by Advocates, namely in terms of facilities & infrastructure, are the lack of honorarium funds needed by advocates in completing the facilities and infrastructure needed, which becomes an obstacle for advocates in enforcing labor law. The conclusion of this thesis is that the obstacles faced by Advocates are the difficulty of presenting the disputing parties, which can be seen from the employer's aspect, where workers hope that the employer element will immediately come to mediate at the Manpower Office, but the employer element does not attend the mediation process. The suggestion from this thesis is that advocates must uphold the value of integrity and adhere to the code of ethics of the advocate profession.en_US
