Inform Consent Sebagai Perlindungan Hukum Dalam Pelaksanaan Tindakan Dokter Dan Paramedis (Studi di Rumah Sakit Umum Bandung)

Abstract

Informed consent merupakan salah satu elemen penting dalam pelaksanaan tindakan medis oleh dokter dan paramedis, sebagai perlindungan hukum dalam pelaksanaan tindakan medis oleh dokter dan paramedis. Tujuan dari penelitian ini adalah untuk menganalisis penerapan informed consent sebagai langkah perlindungan hukum dalam tindakan medis di Rumah Sakit Umum Bandung. Berdasarkan hal tersebut rumusanya masalahnya: Pertama, Bagaimana pelaksanaan informed consent di rumah sakit Bandung-Medan?; Kedua, Bagaimana informed consent memberikan perlindungan hukum bagi dokter dan paramedis; Dan ketiga Apa kendala dan solusi dalam implementasi informed consent di Rumah Sakit Bandung-Medan?. Adapun penelitian ini menggunakan metode penelitian yuridis empiris dengan intrumen pengumpulan data obeservasi, wawancara dan studim dokumentasi. Dengan analisi data deskriptif analisis. Hasil penelitian menunjukkan bahwa meskipun prosedur informed consent telah diterapkan, masih terdapat tantangan dalam pemahaman pasien mengenai hak-hak mereka dan pentingnya persetujuan yang diberikan. Faktor-faktor seperti tingkat pendidikan pasien, ketidaktahuan, serta komunikasi yang kurang jelas antara tenaga medis dan pasien menjadi hambatan dalam penerapan informed consent yang optimal. Penelitian ini menyarankan perlunya peningkatan edukasi kepada pasien dan pelatihan berkelanjutan bagi tenaga medis untuk memperbaiki kualitas komunikasi serta memastikan perlindungan hukum yang maksimal dalam tindakan medis. This study uses an empirical legal research method with data collection instruments of observation, interviews and documentation studies. With descriptive data analysis. The results of the study indicate that although the informed consent procedure has been implemented, there are still challenges in patient understanding of their rights and the importance of the consent given. Factors such as patient education level, ignorance, and unclear communication between medical personnel and patients are obstacles to the optimal implementation of informed consent. This study suggests the need for increased patient education and ongoing training for medical personnel to improve the quality of communication and ensure maximum legal protection in medical actions.
