Peran Kepolisian Dalam Mengungkapkan Kasus Curanmor Di Wilayah Hukum Polrestabes Medan Dan Sekitarnya

Abstract

Tugas dan kewenangan Polisi Republik Indonesia (Polri) telah tertuang dalam Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia yang meliputi pemeliharaan keamanan dan ketertiban masyarakat, penegakan hukum, perlindungan, pengayoman dan pelayanan pada masyarakat. Masalah kejahatan curanmor di wilayah Poltabes Medan dan sekitamya merupakan masalah yang penting yang harus ditanggulangi disamping masalah ekonomi, kesehatan dan lain sebagainya. Korban kejahatan curanmor dapat menderita kerugian yang besar seperti kehilangan mobil, sepeda motor. Belum lagi kerugian yang di derita oleh para korban kejahatan, berupa rasa trauma karena takut oleh kejahatan (fear of crime). Perlindungan keamanan pada masyarakat pengguna kendaraan bermotor terjadi karena adanya 2 faktor, yaitu faktor juridis dan faktor non juridis. Faktor juidis yaitu belum terdapatnya harmonisasi hukum diantara peraturan perundang- undangan, misalnya peran kepolisian dalam penegakan hukum dikaitkan dengan peran penegak hukum lainnya seperti kejaksaan dan kehakiman. Sedangkan factor non juridis belum terdapatnya satu keterpaduan dalam penyelenggaraan penegak hukum antara aparat penegak hukum sebagai criminal justice system. Dalam hal ini diharapkan kerjasama pihak kepolisian dengan masyarakat dalam rangka penanggulangan kejahatan curanmor sangat penting dilakukan. Penerapan peraturan perundang-undangan di lapangan oleh aparat penegak hukum seperti polisi diharapkan terdapat kerjasama yang lebih baik dengan masyarakat. Pengaduan masyarakat terhadap kasus curanmor sangat menentukan keberhasilan aparat kepolisian dalam mengungkap kasus curanmor. Selain itu diharapkan adanya pelatihan atau pendidikan dalam pemberantasan kejahatan curanmor. Security protection for motorized vehicle users occurs due to 2 factors, namely legal factors and non-legal factors. The legal factor is the lack of legal harmonization between laws and regulations, for example the role of the police in law enforcement is linked to the role of other law enforcers such as the prosecutor's office and the judiciary. While the non-legal factor is the lack of integration in the implementation of law enforcement between law enforcement officers as a criminal justice system. In this case, it is expected that cooperation between the police and the community in the context of overcoming motorcycle theft crimes is very important. The implementation of laws and regulations in the field by law enforcement officers such as the police is expected to have better cooperation with the community. Public complaints about motorcycle theft cases greatly determine the success of the police in uncovering motorcycle theft cases. In addition, it is hoped that there will be training or education in eradicating motorcycle theft crimes.
