dc.description.abstract | Tidak semua pelanggaran kode etik yang dilakukan oleh anggota Polri harus diselesaikan melalui sidang disiplin dan sidang Kode etik, namun juga dapat melalui perdamaian.Tindakan-tindakan pelanggaran disiplin dan etik anggota kepolisian yang dapat diselesaikan melalui proses perdamaian memiliki syarat materil yaitu, dimana tindakan tersebut tidak menimbulkan keresahan dan penolakan dari masyarakat, tidak berdampak konflik sosial, adanya pernyataan dari semua pihak yang terlibat untuk tidak keberatan dan memenuhi kriteria pembatas. Permasalahan dalam penelitian ini, yaitu : Bagaimana penegakan hukum pelanggaran disiplin dan kode etik profesi kepolisian di Indonesia dan penerapan Perkadiv Polri Nomor 4 tahun 2021 terhadap mekanisme penyelesaian perdamaian terkait pelanggaran disiplin dan kode etik profesi anggota kepolisian di wilayah hukum kepolisian daerah sumatera utara. Metode penelitian yang bersifat deskriptif kualitatif, sedangkan dalam penelitian deskriptif terdapat beberapa jenis penelitian, salah satunya adalah case study, Mengingat case study merupakan pendekatan penelitian kualitatif yang digunakan untuk memahami suatu permasalahan atau masalah melalui pemanfaatan kemampuan yang ada. Hasil yang didapat adalah anggota Polri yang melanggar kode etik dikenai sanksi sesuai Peraturan Polri Nomor 7 Tahun 2022, mencakup mutasi, penundaan kenaikan pangkat/pelatihan, penempatan khusus, hingga PTDH. Sanksi bersifat kumulatif atau alternatif, dengan mempertimbangkan tuntutan pidana/perdata. Penyelesaian pelanggaran disiplin secara damai diatur dalam Peraturan Kadiv Propam Polri Nomor 4 Tahun 2021, berlaku untuk pelanggaran ringan dengan asas legalitas, profesional, dan transparansi. Mekanisme mencakup penarikan/pencabutan pengaduan sebelum/during penyidikan atau pemeriksaan awal. Propam Polda Sumut menerapkan penyelesaian damai sesuai Perkadiv Propam Polri Nomor 4 Tahun 2021, melalui penelitian administrasi, pernyataan damai, gelar perkara, dan penerbitan SP3, dengan memastikan proses berjalan sesuai aturan tanpa paksaan. Not all violations of the code of ethics committed by members of the Indonesian National Police must be resolved through disciplinary hearings and Code of Ethics hearings, but can also be resolved through peace. Actions of violations of discipline and ethics by members of the police that can be resolved through a peace process have material requirements, namely, where the action does not cause unrest and rejection from the community, does not have an impact on social conflict, there is a statement from all parties involved not to object and meets the limiting criteria The problems in this study are: How is the law enforcement of violations of discipline and the code of ethics of the police profession in Indonesia and the implementation of Perkadiv Propam Polri Number 4 of 2021 regarding the mechanism for resolving peace related to violations of discipline and the code of ethics of the police profession in the jurisdiction of the North Sumatra regional police. The research method is descriptive qualitative, while in descriptive research there are several types of research, one of which is a case study, considering that a case study is a qualitative research approach used to understand a problem or issue through the utilization of existing capabilities The results obtained are that Polri members who violate the code of ethics are subject to sanctions in accordance with Polri Regulation Number 7 of 2022, including transfers, postponement of promotions/training, special placements, to PTDH. Sanctions are cumulative or alternative, taking into account criminal/civil charges. The peaceful resolution of disciplinary violations as regulated in Polri Training Regulation Number 4 of 2021, applies to minor violations with the principles of legality, professionalism, and transparency. The mechanism includes withdrawing/withdrawing complaints before/during investigations or initial examinations. The North Sumatra Police Propam implements peaceful resolutions in accordance with Polri Propam Division Regulation Number 4 of 2021, through administrative research, peace statements, case titles, and issuance of SP3, by ensuring that the process runs according to the rules without coercion. | en_US |
